Whereas police officers are obliged to abide by legal provisions on "legitimate defence", gendarmes have had the powers to halt fleeing or escaping suspects by firing at them, as long as the officers concerned were in uniform and had made a warning signal first, such as firing a shot into the air.
The problem of identifying police officers who may have been involved in a human rights violation arises mainly when an alleged victim of police abuse has no witnesses independently of police officers; when officers refuse to testify against their colleagues or when testimonies are not sought by those conducting the inquiry.
The police officers appealed against the sentence, and in February 2002 the 10-month suspended prison sentence was reduced to an eight-month suspended prison term, thereby making the officers eligible for an amnesty and allowing them to continue their careers in the police force.

None the less police culture does exist and is governed by a set of rules which this author considers to be fairly universal, based on over twenty years of work within the police in France but also with other police services, both in the field and in the academic arena.
The minister of the Interior (in charge of police) was happy  to have a more responsible police, the police unions were happy with new relations with their hierarchy and the public was reassured to have a police respectful of law and the interests of citizens.

She stated that she was never formally questioned by the police officers while in police detention and it would appear that she was not charged with any offence (a press report indicated that before leaving the station she refused to sign a form, accusing her of being "drunk on a public highway").

Police claimed that the killings occurred in a "shoot-out" between HNP agents and individuals in a pickup containing weapons.
In a troubling response, the commanding officer of the Jacmel police station, Inspector Jean-Gabriel François, said that beating prisoners was a necessary police practice since "these people are criminals."37 Serious beating and torture cases have been documented in the region under François's command.
