  Political Asylum Attorney Washington DC
Political asylum is granted to people who are afraid if they return to their home country they may be persecuted.
To win asylum because you are afraid of returning to your home country, you must show the judge that your fear is "well-founded." Thus, you must convince the judge that you truly believe you're in danger, that you have good reasons for this belief, and that someone else in your position would also be afraid.
Anyone who applies for political asylum and has persecuted someone else because of that person's political opinion, her membership in a social group, her religion, her race or her nationality may not be granted political asylum, no matter how strong the case may be.

Political Asylum: The Achilles Heel of Immigration Reform
Political asylum is the most idealistic, most uncontrollable, and most poorly managed of all features of the country's convoluted immigration rules.
The asylum system is subverted by interest groups' skillful manipulation, by often uninformed compassion among Americans, and by the extreme and unworkable definition of "due process" that asylum's advocates have fastened upon it.
Though the number actually granted asylum is far lower, nearly 500,000 aliens outside the legal immigration process now have gained legal or de facto permanent residence with the help of their access to the asylum channel.

New Asylum Laws: Undermining an American Ideal
Moreover, many of those who do not receive asylum may actu- ally be fleeing persecution but either do not meet the threshold imposed by U.S. law or do not possess adequate legal counsel to convince the INS or an immigration judge of the merits of their claims.
As a result, judgments on whether an asylum applicant has satis- fied the standard for a grant of asylum often hinge on the testimony of the asylum applicant--particularly his or her credibility and demeanor, the level of detail of the ac- count, and whether the account of persecution is inherently consistent.
Sometimes the asylum offi- cer travels to the detention facility only to learn that the asylum seeker is not prepared to proceed with her case on that particular day, because, for example, her rights have not previously been explained to her.

On the contrary, in the case of diplomatic asylum, the refugee was on the territory of the State in which he had committed the offence: the decision to grant asylum derogated from the sovereignty of the territorial State and removed the offender from the jurisdiction of that State.
It therefore followed that Colombia, as the State granting asylum, was not competent to qualify the nature of the offence by a unilateral and definitive decision binding on Peru.
It was not sufficient to be accused of a political offence in order to be entitled to receive asylum; asylum could only intervene against the action of justice in cases where arbitrary action was substituted for the rule of law.
