USA: Polygamy related abuses in Utah

(Site not responding. Last check: 2007-10-20)
Polygamous marriages are practiced on a large scale especially in the State of Utah, but in neighbouring U.S. states as well.
The religious teachings of these polygamous groups and the closed nature of their communities create conditions in which women and girls are especially vulnerable to violence, coercion, and abuse.
Women and girls who have fled polygamous families report that religious teachings emphasize their duty to submit to the authority of their fathers, husbands, and male religious leaders, and make spiritual salvation contingent on polygamous marriage.

 CATHOLIC ENCYCLOPEDIA: History of Marriage
Hence polygamous marriages are found for the most part among the kings, chiefs, strong men, and rich men of the community; and its prevailing form seems to have been bigamy.
Moreover, polygamous unions are, as a rule, modified in the direction of monogamy, inasmuch as one of the wives, usually the first married, occupies a higher place in the household than the others, or one of them is the favourite, and has exceptional privileges of intercourse with the common husband.
Among the principal causes of polygamy are: the relative scarcity of males, arising sometimes from numerous destructive wars, and sometimes from an excess of female births; the unwillingness of the husband to remain continent when intercourse with one wife is undesirable or impossible; and unrestrained lustful cravings.

The Biblical Data On Polygamy - Chapter One   (Site not responding. Last check: 2007-10-20)
Polygamous societies have existed in America (most notably the nineteenth century Mormons), and remnants are still present.
If the validity or invalidity of the polygamous argument can be ascertained, the severity of the clash between opposing forces could be reduced by proposing that positions be compromised or abandoned in accordance with this study's conclusion.
When polygamous marriage is then viewed in relation to an already-established concept of marriage (monogamy), polygamy is easily seen to fall short of the divine intent of marriage (which is monogamy) and more importantly even disqualified as a legitimate marriage form by definition.

A brief history of polygamy in southern Africa   (Site not responding. Last check: 2007-10-20)
A broad survey of homestead patterns in the region reveals that whilst a number of polygamous settlements may still be found in the rural countryside, these are in a distinct minority, and monogamous marriages appear to be the general norm.
The practice of polygamy may, in most cases, be explained in terms of a levirate, a social practice, used to ensure the continued status and survival of widows and orphans within an established family structure.
While it is true, therefore, that every rural family is potentially polygamous in nature, we need to question whether such polygamy was the result of "male sexuality and lust", as the missionaries would have it, or merely the enforcement of social obligations intended to reinforce ties between family or clan groupings.

Mormon Polygamy after Wilford Woodruff's manifesto
Polygamous husbands and wives prior to the Manifesto had made sacred covenants with each other and God to multiply and replenish the earth, and the 1891 official interpretation of the Manifesto required them to break those covenants either through total abstinence or by divorce.
The result was that most pre-1890 polygamists and every polygamous General Authority continued to cohabit with their plural wives of childbearing age.
Under criminal law, such an additional marriage was untouchable because the law did not recognize the validity of any polygamous marriage; therefore pre-existing, continuing polygamous marriages could not be a legal impediment to a civil marriage with a new wife.

This particular marriage (i.e., to a 13 year old girl) certainly strikes one as questionable at best (and according to this story the circumstances are indeed repugnant) but the judge seems to have felt that even a polygamous marriage involving all consenting adults was equally repugnant.
Obviously the character of the marriage must be fixed at its inception, and if it is originally polygamous under its proper law, the change of domicile cannot either entitle it to recognition as a marriage in the English sense or render illegal and void what is originally lawful and valid.
