The Port argues that the Port is entitled to discretionary immunity because the Port weighed the risks of building a deer fence against the alternatives, involving basic governmental policy.
In specific, the Port maintains that the plaintiff knew there were deer hazards on the runway and assumed the risk of landing at the airport at night knowing the potential danger of deer on the runway.

On May 28 1858, title to the 3.5-acre island then known as Port Du Morts was transferred to the Lighthouse board for the construction of a new light station, and later that same year, work began on constructing the new station on Port Du Morts Island.
