		Porth's complaint alleged Arthur Glasoe told Porth he was going to "'get her'" and "'take five acres of land from her'" and thereafter Curtis deliberately and fraudulently conducted a survey in a manner to deceive her as to the correct location of the property line.
		Porth had the burden of showing the testimony of her proposed witnesses was necessary and relevant to prove issues to be tried.
		Porth presented contrary evidence which showed she believed Curtis's survey was intended to be a final representation of the property line and which may have supported an inference of fraud.
