Defendants William and Norma Ruby appeal from the Rutland Superior Court's entry of summary judgment for plaintiff Town of Poultney declaring Poultney owner of a parcel land which is partially located in the Town of Wells, Vermont, and permanently enjoining the Rubys from trespassing on that land.
At the post-remand hearing before the trial court, Poultney notified the court of the quitclaim deed and suggested that the issue on remand, that is, the revision to limit the no-trespass order to the portion of Poultney's property located in Poultney, was now moot.
The Rubys next argue that the court erred by declaring Poultney owner of the entire disputed lot because the complaint stated a claim for trespass and was not a request for a declaratory judgment or a petition to quiet title.

Poultney is a town in Rutland County in the southwest of the U.S. state of Vermont.
Poultney was charted in 1761 by Benning Wentworth, Royal Governor of New Hampshire, and named for William Johnstone Pulteney, Member of Parliament and at one time the richest man in Great Britain.
In the town the population was spread out with 21.1% under the age of 18, 17.6% from 18 to 24, 25.0% from 25 to 44, 20.3% from 45 to 64, and 16.0% who were 65 years of age or older.

One of the earliest settlers was William Ward who came to Poultney from Marlborough, MA.
He served as town moderator, Justice of the Peace, Deacon in the Baptist Church, Poultney's representative to the Dorset assembly in July 1776 which declared Independence from Great Britain, and the assembly of September 1776 in which the people declared independence from New Hampshire.
Later he represented Poultney in the first General Assembly of the new State of Vermont at Bennington in 1778, and became a judge for Rutland County.
