  87609 -- State v. Prater -- Wahl -- Kansas Court of Appeals
Prater appealed and a panel of this court, citing lack of evidence, reversed his aggravated arson conviction and remanded to the district court with orders to enter a new conviction for attempted aggravated arson.
Prater argues that during the period between the issuance of the mandate and the entry of conviction by the district court, his conviction in that case was void.
Prater contends the district court erred in refusing to allow him to withdraw his plea for the 2000 offense after he disclosed to the court that he had entered his plea without understanding the status of his appeal for the 1997 offense or its effect on his criminal history score.

The Austin Chronicle Politics: Beaten by Wackenhut   (Site not responding. Last check: 2007-10-12)
Prater and his Austin attorney, Sidney Childress, allege that the Florida-based Wackenhut Corp. did not fulfill its responsibilities under the contract signed with Travis County for operations of the state jail facility.
Kathryne Cool, David Prater, and Sidney Childress argue that Wackenhut's ouster from Travis County reinforces their claims that the prison was run poorly from day one, and that the company was not only abusing prisoners but also bilking Texas taxpayers.
Prater is understandably frustrated by his quixotic attempt to take on Wackenhut, and can only hope that his experience, in jail and afterward, can at least serve as a warning to the politicians and public enamored of the continuing privatization of public services.

 40 Wn. App. 639, PRATER v. KENT
Prater was treated for the hearing loss by her doctor, and received the City's permission to be absent from work through May 31, 1977.
Prater initially gave the City a "time loss card" completed by her doctor for the Department of Labor and Industries, stating that Prater was not able to return to work, was under treatment, and the extent of her disability was unknown.
Prater's argument that the City failed to make reasonable accommodation for her handicap need not be considered in light of the court's finding that Prater did not provide enough information for the City to evaluate her condition and place her in another position.
