A successor State may provide that persons concerned who, in relation to the succession of States, voluntarily acquire the nationality of another successor State or, as the case may be, retain the nationality of the predecessor State shall lose its nationality acquired in relation to such succession.
Predecessor and successor States shall grant a right of option to all persons concerned covered by the provisions of articles 24 and 25, paragraph 2, who are qualified to have the nationality of both the predecessor and successor States or of two or more successor States.

A finite state machine (FSM) specifies the events of interest to a reactive object, the set of states that object may assume, and the actions (and their order of execution) in response to incoming events in any given state.
When the object is in the predecessor state (from which the transition arises) and the named event is sent to the object, the transition fires and the object moves to the new state executing the specified actions along the way.
The primary difference between or-states and and-states is that when the object is in the enclosing composite state, it must be in every active and-state simultaneously (in other words, logically concurrent).

States are not required to attribute nationality to persons concerned who have their habitual residence in another state, and cannot force nationality upon persons with habitual residences in other states without their consent unless they would become stateless.
States are to give consideration to the will of persons concerned by granting a right to opt for nationality where appropriate, and may make the voluntary acquisition of the nationality of a successor State a condition for the loss of its own nationality.
Predecessor States shall withdraw their nationality from persons concerned that qualify for successor State nationality, so long as the persons concerned have already acquired the nationality of the successor State.

Successor States may therefore be held accountable for violations committed by the predecessor State, in accordance with any reporting and complaints procedures accepted by the predecessor State.

This is due, in part, to the traditional limitation of customary international law to relations among states, and to the conventional belief that private claims can be resolved by national legal systems of the debtor or creditor states according to private-international-law principles for adjudicative jurisdiction, judgment recognition and enforcement and choice of law.
The Act of State Doctrine thus is a powerful barrier to litigation of private claims in national courts, when the outcome of the litigation is determined by an expropriation or nationalization law.
