But a new Dil capable of agreeing on the selection of a new government could not be elected as there would be no government capable of having it dissolved, as an Executive Council defeated by the Dil was constitutionally debarred from seeing a parliamentary dissolution.

The Executive Council shall prepare Estimates of the receipts and expenditure of the Irish Free State (Saorstt Eireann) for each financial year, and shall present them to Dil Eireann before the close of the previous financial year.
The Government of the Irish Free State agrees to pay fair compensation on terms not less favourable than those accorded by the Act of 1920 to judges, officials, members of Police Forces and other Public Servants who are discharged by it or who retire in consequence of the change of government effected in pursuance hereof.

De Valera was president of the executive council of the Irish Free State from 1932 to 1937 and was elected premier of Eire under the new constitution of 1937.
He headed the Sinn Féin, and then a dissident faction called the Fianna Fáil, and held a number of political roles during the 1930s.

De Valera resigned the presidency (which in August 1922 had been upgraded from a prime ministerial President of Dáil Éireann to a full head of state, called President of the Irish Republic).
