The tightly-knit world of family law is still reeling from last week's announcement that a former commercial court judge, with no experience of the workings of the high court's family division, is to be handed the job of running it.
The president of the family division is appointed by the Queen on the recommendation of the prime minister, but the candidate is, in effect, chosen by the lord chancellor.
Family judges themselves accept that, while there is no judicial bias against fathers, the system for dealing with disputes between parents over contact with their children has in-built flaws which need to be rectified.

 Civitas: Family Law and Judges' Personal Opinions
The President of the Family Division, Dame Elizabeth Butler-Sloss, gave an interview this evening in which she articulated the degree to which she supposes--and presumably acts on the supposition--that it is up to her to decide whether Parliament is being sluggish in making the necessary reforms in family life.
The personal lives and moral beliefs of such family judges, therefore, have a public relevance that those of judges who deemed their duty was to strictly follow the text of the law, or at most to fathom the intentions of Parliament, did not have.
I think it's entirely appropriate that the Head of the Family Division, the Divison of judges who try these cases particularly in relation to terminally ill people, whether they're children or adults, should be able to say that this is a Bill that we as a Judiciary support.

 Domestic Violence
Whilst the Family Court sees only those families who have separated, it would be wrong to ignore the fact that many victims and their children may continue to live with violent partners for a significant period of time, sometimes with tragic consequences.
In most cases, the breakdown of a family does not mean the severing of all relationships between family members.
In Re L, we said that there were four factors requiring specific analysis in every case: first, the extent of the violence; second, the effect upon the primary carer; third, the effect upon the child; and fourth, the ability of the offender to recognise his/her behaviour and attempt to change it.

The Family Division is presided over by the Lord President of the Family Division; it hears cases relating to matrimonial affairs, child welfare, child custody and adoption.
The Court is divided into the Civil Division (presided over by the Master of the Rolls) and the Criminal Division (presided over by the Lord Chief Justice, who is also the head of the Queen's Bench).
In civil cases, the Lord Chancellor, Lord President of the Family Division, Vice-Chancellor and other judges of the High Court may sit along with Lords Justices of Appeal in hearing cases.

 Society | New panel to reform family justice unveiled
The creation of the Family Justice Council (FJC) comes after claims by judges and fathers' groups that men seeking contact with their estranged children are being unfairly treated by the family courts.
The family justice minister, Lord Filkin, confirmed that he hoped the green paper would be published before the parliamentary summer recess on July 22.
The FJC brings together 19 senior judges, family lawyers, paediatricians and child and family welfare experts, including the children's commissioner for Wales, Peter Clarke.

THE families of two children who contracted variant CJD have been given permission by the High Court to seek access to a radical new treatment never before tried on humans.
But since Dame Elizabeth Butler-Sloss, President of the Family Division, gave the go-ahead for doctors to use the drug, the hospital trust involved has refused to carry out the treatment.
The families, who have consented to the blood-thinning drug pentosan polysulphate being injected into the teenagers’ brains, are hoping the treatment will slow down further brain damage.

Families Need Fathers, with others, led a fundamental assault on the underlying philosophy which gives one parent "residence" and the other "contact", when the objective should be to achieve the full involvement of both parents in the care and upbringing of their children post separation.
We have a huge number of families who, with some additional input, could perhaps be moved on from supervised to supportive contact and some from supported contact to unregulated contact with the option of a quarterly review.
Families Need Fathers, whose response to the consultation overall was detailed, clear and for the most part extremely helpful, acknowledged that the idea behind supported Contact Centres was well-intentioned and that many of the volunteers were largely supportive of fathers.

Many victims of violence remain afraid of their former partners and that fear is obviously communicated to the child, not necessarily by the parent telling the child of his/her fear.
As in other areas of family law where children are concerned, the stability of the placement for the child is of crucial importance since its breakdown, or the undue fragility of the primary carer, can have serious consequences for the child.
Once the court has found proved violence which is significant and relevant to the disposal of the case, the court must not only consider the effects of that violence on the child and the primary carer, but should also consider the response of the perpetrator of the violence.
