Preston now argued that ordinance  10-26 was validly enacted and that since it permitted the use of muzzleloading rifles for hunting small game animals outside the general open season for deer and turkey, under 4 VAC  15-90-80 the use of muzzleloading firearms must be permitted.
Preston also argues that the trial court erred in finding the gun she used to be a "muzzleloading rifle," and in finding that the provisions of  10-26 were void due to Southampton County's failure to properly notify DGIF of the changes in 1991.
Preston is incorrect in arguing that the trial court made the determination that  10-26 was invalid due to Southampton County's failure to notify DGIF of the amendments.

Preston County recorded net job losses during the first six years of the 1990s, but construction and manufacturing were bright spots for the county with growth rates above the statewide average.
The county recorded population gains during the 1990-97 period and experienced a drop in the unemployment rate from 12.7 percent in 1992 to 8.8 percent in 1997.
The county is forecast to reverse the small job losses during the first six years of the decade and to post growth at a faster rate than is currently expected for the state or the nation.

When Grievant expressed her reluctance to transfer to West Preston, she was allowed to remain at Central Preston and serve in the position of an aide who was on a leave of absence.
The administrative law judge found that Nicholas County's decision to make all their special education aides itinerant was a logical solution to the problem which occurs when the student transfers, leaving the aide behind at a particular school with no specific assignment, and requiring that a new aide be hired at the other school.
Employees of county boards of education must be notified in writing by the first Monday in April of any proposed transfer for the ensuing school year, are entitled to a hearing before the board, and action on all proposed transfers must be taken by the first Monday in May. W.

Preston County, as with the rest of America, enjoyed a period of prosperity after World War I. As can be seen, practically every district built new school which subsequently served as high school for that district.
During 1968 and 1969, employers throughout the county were involved in the study of the present and projected job possibilities in the county, which helped serve as the basis for the curriculum for the countywide vocational-technical school, Preston County Education Center, (PCEC) which was placed in operation in September 1972.
The population of Preston County declined from 31,399 in 1950 to 29,037 in 1990 (-8%).

Preston County was created by an act of the Virginia General Assembly on January 19, 1818, from parts of Monongalia County.
Preston County was visited by several trappers and hunters during the early 1700s, but their names were not recorded.
Although the first meeting of the county court was supposed to convene on the first Monday in March 1818, it was actually held in early April 1818 in the upper east room at the house (tavern) of Colonel William Price in Kingwood.

I. Charles W. Haney, the appellant, is an employee of the Sheriff of Preston County, West Virginia, and the County Commission of Preston County, the appellees.
The Preston County Commission subsequently moved for summary judgment on the grounds that it is expressly exempted as an employer under the state wage and hour law because at least 80% of its employees are covered by federal wage and hour law.
We have thus far found that the Preston County Commission, as a political subdivision, falls within the language of W.Va. Code § 21-5C-1(e) which exempts certain employers from the state wage and hour law when 80% of their employees are subject to federal wage and hour laws.

The terms of this requirement were to be set forth in a contract agreement between the State Board and the Preston County Board of Education.
As such, it is my interpretation that those students who reside in Preston County but who currently attend Tucker County Schools do so with the express agreement of the Preston County Board of Education as provided in the Memorandum of Agreement signed by the Preston County Board of Education on April 9, 1990.
Further, based on the Memorandum, it is proper for Tucker County to continue providing bus transportation to those students living in the Aurora area, as it has done for a number of years.
