 PRICE WATERHOUSE v. HOPKINS - Majority Opinion
Price Waterhouse places no limit on the number of persons whom it will admit to the partnership in any given year.
Despite Price Waterhouse's attempt at trial to minimize her contribution to this project, Judge Gesell [490 U.S. 228, 234] specifically found that Hopkins had "played a key role in Price Waterhouse's successful effort to win a multi-million dollar contract with the Department of State." 618 F. Supp., at 1112.
Noting that Price Waterhouse could avoid equitable relief by proving by clear and convincing evidence that it would have placed Hopkins' candidacy on hold even absent this discrimination, the judge decided that the firm had not carried this heavy burden.
