Like many provisions in the Bill of Rights, the meaning of the Eighth Amendment's language on "cruel and unusual punishment" and the scope of prisoners' rights have been influenced by prevailing public opinion, interest group advocacy, and--most importantly--the ideological values of the nine individuals who sit on the Supreme Court.

Hernandez involved a prison inmate's appeal of the dismissal of three in forma pauperis complaints that he had filed against prison officials at several California prisons.
The government presented its involvement in the case as a function of its responsibility for defending against in forma pauperis actions brought by prisoners alleging violations of their rights by federal officials.
But what that observation tells us about Judge Roberts's regard for prisoners' rights is less clear given that two of the Court's most diligent defenders of prisoners' rights--Justices Stevens and Blackmun--explicitly declined to criticize the Court's partial agreement with the government as an illegitimate narrowing of a prisoner's right to be heard.
