Topic: Privative a

The Internet Classics Archive | Categories by Aristotle
Opposites in the sense of 'privatives' and 'positives' are' blindness' and 'sight'; in the sense of affirmatives and negatives, the propositions 'he sits', 'he does not sit'.
Blindness is a 'privative', to be blind is to be in a state of privation, but is not a 'privative'.
In the case of 'positives' and 'privatives', if the subject does not exist at all, neither proposition is true, but even if the subject exists, it is not always the fact that one is true and the other false.

Fake Guns and Stone Lions: Conceptual Blending and Privative Adjectives   (Site not responding. Last check: 2007-10-15)
Kamp (1975) defines a privative adjective as one for which, given adjective A and noun N, the claim 'No AN is a N' is necessarily true. For example, 'fake' is a privative because 'No fake gun is a gun,' is true by definition.
Senses of privative constructions are built up in a similar way as senses for other sorts of compounds: by recruiting attribute-value structures for the modifier and the head, and performing operations on the representations in order to yield the resultant compound sense.
Although the sense generation model provides a clever mechanism to provide the meanings for functional privatives in which the head is physically constructed from the modifier (as in 'stone lion'), it is compromised by the requirement that the implicitly attached lexical concept be subsumed by the phrase it instantiates.

The effect of the privative clause at Section 474 became a matter of dispute in the Federal Court.
The High Court held that the privative clause was constitutionally valid.
In effect, the High Court held that the privative clause only protects decisions which comply with all important substantive and procedural requirements in the Migration Act.

Australian Public Law   (Site not responding. Last check: 2007-10-15)
The old traditional approach of interpreting a broad, general privative clause as only ousting non-jurisdictional error of law on the face of the record is a classic example of this approach.
Governments should be restrained in their use of privative clauses, and courts should respect them when they are employed, at least by conceding them some reasonable area of effective operation.
However, privative clauses, whether in State or Commonwealth legislation, are construed "by reference to a presumption that the legislature does not intend to deprive the citizen of access to the courts, other than to the extent expressly stated or necessarily to be implied".

 Migration Act Privative Clause 2002
The privative clause, and the related provisions, will replace the existing judicial review scheme at Part 8 of the Migration Act.
The privative clause does not mean that access to the courts is denied, nor that only the High Court can hear migration matters.
Counsel’s advice was that a privative clause would have the effect of narrowing the scope of judicial review by the High Court and of course the Federal Court.

Privative Clauses and the Australian Constitution
In this decision the High Court considered a privative clause inserted into the Migration Act 1958 in 2001.
While the Court did not go so far as to strike the clause down for non-conformity with the Commonwealth of Australia Constitution, it did construe the clause narrowly in light of what it regarded as constitutional imperatives, leaving limited scope for the enactment of legislation to limit the scope for judicial review of administrative actions.
The Court’s approach may prove to be of relevance in interpreting similar clauses in other Commonwealth jurisdictions which lack a paramount written constitution.

 Agnosticism
The intellectual community contained, at the time, Sir Thomas Huxley, and he coined the word agnostic in 1869 to keep from aligning himself with the hard-pressed Bradlaugh.
The word gnosis is the Greek for "knowledge." In words of Greek derivation the prefix a is a privative, that is -- it gives the word a negative sense.
Literally it means "against knowledge" or "negating knowledge." Huxley in his letters to the literate community pointed out that he did not feel that salvation could be attained through knowledge.

Abstract: The Proposed Privative Clause in the Migration Act - friend or foe to Australian Immigration Law ?   (Site not responding. Last check: 2007-10-15)
This paper argues that the inclusion of a privative clause into the Migration Act 1958, purporting to oust the Federal and the High Court from reviewing migration decisions, is a necessary and clever move.
The author supports their claims by ascertaining that no miscarriage of justice would occur if the tier of judicial review were removed in most circumstances, making reference to RRT decisions.
The author further contends that judicial review is more about helping the system than the individual, thus dismissing claims that the privative clause would infringe upon human rights.

Migration privative clause may prove a model
Now, in a more far-reaching step, the Parliament has legislated to severely limit the jurisdiction of the Federal Court and the High Court in migration matters.
The Migration Legislation Amendment (Judicial Review) Act 2001, which was enacted last September, has introduced a 'privative clause' for most decisions made under the Act.
A privative clause is a provision which on its face ousts all judicial review but which the courts (most famously in the High Court's 1945 decision in R v Hickman; ex parte Fox and Clinton) have interpreted as limiting judicial review to jurisdictional error and certain other narrow grounds.

The Human Rights and Equal Opportunity Commission has been granted leave to intervene in a High Court case (No. S134 of 2002) relating to the so called "privative clause" in the Migration Act.
The "privative clause" was inserted into the Migration Act 1958 last year.
The clause aims, among other things, to restrict the ability of the Federal and High Court to judicially review decisions of the Refugee Review Tribunal and the Migration Review Tribunal.
