  Administrative Histories - Probate Court
The Illinois General Assembly granted probate jurisdiction to the clerk of the county commissioners’ court in 1819.
Only two years later, in 1821, the functions of the probate court were transferred from the clerk of the county commissioners’ court to county probate courts.
By the terms of the Judicial Amendment of 1962, the functions of both the probate courts and the county courts were transferred to the circuit courts, effective January 1, 1964.

 Probate Court
Probate is a legal process during which a court oversees the distribution of assets left by a deceased person’s will.
If such an affidavit is unavailable, the personal presence of the witnesses will be required in court to testify that at the time the will was signed, the deceased person was of sound mind and knew what he or she was doing.
After court approval of the account and payment of all unpaid probate expenses, the deceased person’s assets are distributed to the people and entities (such as charities or trusts) named in the will or, if the person died without a will, to the heirs of the deceased person.

In an emergency, a probate court may adopt and publish a local rule not inconsistent with these rules; provided, however, that such rule or rules shall be submitted to the Supreme Court for approval within 10 days of adoption and a copy shall be forwarded to the State Bar of Georgia.
Whenever a judge of the probate court appoints an attorney to act in his stead pursuant to O.C.G.A. 15-9-13(a), said appointment shall be by written order which shall specify the cases or time period covered and shall be recorded in the minutes of the court.

Once the petition is filed, the Court generally appoints a "guardian ad litern" to visit the person who is alleged to be disabled, to explain to that person the nature of the proceeding and his or her rights under the law, and to report back to the Court.
The guardian ad litern reports to the Court his or her opinion of the validity of the petition, the interview with the proposed disabled person, and the position of that person concerning the appointment of a guardian.
If the Court receives any such request, even in the form of a very informal note, the Court is required to hold a hearing to determine whether or not the disabled person is still disabled, and whether the order previously entered should be changed in any manner.

 Probate Court Conservatorshiop
A probate conservatorship is a court proceeding where a judge appoints a responsible person (called a conservator) to care for another adult who cannot care for him/herself or his/her finances (called a conservatee).
To ask the Court for these special medical powers, a physician or licensed psychologist must fill out the Capacity Declaration—Conservatorship form GC-335, which you must then file with the Court.
Section 2580 of the Probate Code says the Court can have the conservator use “Substituted Judgment” to make a Will, a trust, or both, to make sure the conservatee has an estate plan.
