 | | Critical habitat is not determinable when one or both of the following situations exist: (i) information sufficient to perform required analyses of the impacts of the designation is lacking, or (ii) the biological needs of the species are not sufficiently well known to permit identification of an area as critical habitat (50 CFR 424.12(a)(2)). |
 | | Once designated, critical habitat has only one regulatory impact: under section 7(a)(2), Federal agencies must, in consultation with the Service, insure that any action they authorize, fund, or carry out is not likely to result in the destruction or adverse modification of critical habitat. |
 | | Critical habitat actions are funded separately (funding still is allocated through the listing subactivity), and critical habitat actions will be prioritized on an annual basis. |
