Provigo is authorized to issue an unlimited number of common shares and an unlimited number of preference shares, issuable in series.
Provigo delivered a notice dated July 12, 2004 to the Commission under subsection 13.2(2) of NI 51-102 stating that it intends to rely on the Previous Order and the No-Action Letter to the same extent and on the same conditions as contained therein.
As Provigo is exempt from the requirements to file interim and annual financial statements pursuant to NI 51-102, and is not required to file interim or annual MDandA or an AIF, it would not be meaningful or relevant for Provigo to file its own Annual Certificates and Interim Certificates.

Provigo is a Quebec-based grocery retailer consisting of over 300 stores and franchises throughout the province.
Provigo was founded in 1969 by a consortium of four wholesalers under the Couvrette and Provost name, of which they would later change to Provigo in 1970.
But as they began acquiring other chains in the 1970s and 1980s they decided to consolidated them into one name, so all of the stores, including those they would later acquire, were renamed Provigo in 1979.

Stated somewhat differently, Provigo submits that there can be little doubt that the granting of the guarantee by Loblaw in exchange for an exemption to Provigo from the continuous disclosure requirements is not prejudicial to the public interest as it is clearly in the interest of the debenture holders, being the public for this purpose.

The temporary closure of the supermarket was caused by an early morning fire that took place on Sunday, October 1 in the warehouse of an art gallery, Grenier d'art, located on top of the Provigo store.
Two men were arrested in relation to the incident, and the Provigo store, having suffered heavy damages, is set to reopen in a few weeks.
Laurent Pepin, Provigo's public affairs communications director, estimated the damage suffered by Provigo in the ballpark of $10,000.

Fleisher noted that his products are peanut-free and alleges he might have been liable if the products actually being sold did not contain the ingredients listed and a consumer was endangered because of allergies.

At closing, Provigo will receive about $81 million (U.S.) cash, which represents 85 percent of Medis' book value, and will make a 50-percent equity investment in the new company.
