The word "prurient," as used in subsection (2)(a), is defined in subsection (8) to mean "that which incites lasciviousness or lust." 7.48A.010(8).
Pullman Co., 312 U.S. Reaching the merits, the Court of Appeals held that by including "lust" in its definition of "prurient," the Washington state legislature had intended the statute to reach material that merely stimulated normal sexual responses, material that it considered to be constitutionally protected.
As already noted, material appealing to the "prurient interest" was itself the definition of obscenity announced in Roth; and we are quite sure that by using the words "lustful thoughts" in footnote 20, the Court was referring to sexual responses over and beyond those that would be characterized as normal.

To be prurient is to be characterized by inordinate and unhealthy sexual interest or desire.
"Prurience" -- the perennial itch of mankind -- is the bete noir of all censors.
Note that "community" standards—not national standards—are applied as to whether the material appeals to the prurient interest; thus, material may be deemed obscene in one locality but not in another.

Appealing to the prurient interests means the material attempts to or intends to appeal generally to a shameful or morbid interest in sex, nudity or excretion which goes substantially beyond customary limits of candor in description or representation of such matters.
The material must be considered as a whole, looking at the dominant theme, and should not be considered on the basis of isolated passages.

 Is Pornography Bad?
Prurience and patent offensive are determined according to the local community standards of the jurors trying the case-- a problematic approach when it comes to materials transmitted over the Net or posted on private BBS's accessible from anywhere.
The rather pedantic "prurience" and "patent offensiveness" tests have been described as follows: the material must turn you on ("prurience") and gross you out ("patent offensiveness").
The SLAP test suggests that material of equivalent prurience and offensiveness may stand or fall depending on whether there is an artistic element or other aspect of legitimate speech.

In 1771, the Scottish naturalist William Smellie used an article in the first edition of the Encyclopaedia Britannica (of which he was the main compiler) to attack the “alluring seductions” of the Linnaean system of plant classification.
His outrage was shared by the English naturalist William Goodenough, who was appalled by Linnaeus’s “disgusting names, his nomenclatural wantonness, vulgar lasciviousness, and the gross prurience of his mind”.
The subject of all this moral outrage was the methodus propria (“proper method”) of plant classification, devised by the Swedish naturalist Carl von Linné, better known by the Latinized version of his name as Linnaeus.

The Starr report confronted congressional smut warriors with an inconvenient reality: The prurient is often political.
While lurid at times, the report isn't "harmful to minors," according to the three-part test Oxley's bill would establish to judge potentially damaging material.
It certainly appeals to one's "prurient interest" and describes "perverted sexual acts"--the first two prongs of the harmful-to-minors test.

The left-liberal Guardian denounced the way CBS had plumbed "new depths of prurience"; the Daily Mail thundered on about the "ultimate betrayal." Much of the media here, though, had few qualms about showing images of, say, mutilated Americans in Fallujah.

They tell us what we instinctively feel about moral questions, which is not always what we say we say in public statements.
The modern political class, for whom tolerance is the only virtue, would like to say, ``It's not the sex, it's the tabloids.'' On this view, private sexual behavior, however bizarre, can never be a scandal.
It is simply an aspect of ``human nature.'' The real scandal is the tabloids -- the vanguard of public prurience (itself a pejorative description of respectability).

Our political and our wider culture have been enriched by imaginative forms of gossip, from Aristophanes to the Goncourt Brothers and on to J 1000 oan Rivers and even Larry Flynt, whom the Supreme Court laudably protected when his ad parody of the pompous Jerry Falwell led to litigation.
But the kind of gossip that serves as a check upon power seems debased in this recent cycle of prurience, as though we had committed ourselves to daily whisperings that we would not tolerate about our neighbors at the backyard fence.
