In order to do this, this article will: (1) establish the basis for anti-spam laws, (2) establish a doctrinal framework in which to analyze anti-spam laws that affect political speech, (3) analyze the current necessity for anti-spam laws, and (4) conclude that anti-spam laws, as presently proposed, are unconstitutional.
Since by its plain language, the statute is intended to affect "commercial electronic mail messages," the definition of this term is crucial to the constitutional analysis of the statute as a whole.

When law schools began restricting the access of military recruiters to their students because of disagreement with the Government's policy on homosexuals in the military, Congress responded by enacting the Solomon Amendment.
Law schools remain free under the statute to express whatever views they may have on the military's congressionally mandated employment policy, all the while retaining eligibility for federal funds.
According to FAIR, law schools' ability to express their message that discrimination on the basis of sexual orientation is wrong is significantly affected by the presence of military recruiters on campus and the schools' obligation to assist them.

Public Disclosure and Access Rules Described
Public access must be provided promptly on request by allowing inspection of the documents at the organization's office or offices, and by providing copies of the documents promptly in response to any in-person request or within 30 days for a written request.
Since the law doesn't take effect for those organizations until the regulations are released, private foundations need only adhere to the earlier and far weaker public accessibility law already in effect.
Since the only difference under the law between private foundations and any other 501(c) organizations are that they must release the names and addresses of donors, it is not obvious why the IRS excepted them, or how long it will take for the applicable regulations to be released.

Were it not for the hundreds of pages of briefing respondents have submitted on the issue, one would have thought it fairly clear that this text does not permit the EPA to consider costs in setting the standards.
That factor is both so indirectly related to public health and so full of potential for canceling the conclusions drawn from direct health effects that it would surely have been expressly mentioned in §§108 and 109 had Congress meant it to be considered.
