Crowson's lawsuit says she bought the ground beef from a Bellevue QFC on Dec. 22 and on Dec. 23, the day the U.S. Department of Agriculture (USDA) announced the disease had been found in a slaughtered Yakima County dairy cow.
QFC's Burt said the supermarket chain relied in part on newspapers and television to get the word out about the meat recall.
QFC, Albertsons, Fred Meyer and several other supermarkets announced Dec. 24 that they were voluntarily taking the meat off their shelves.

The suit alleges QFC negligently sold the meat and did not appropriately notify the family -- and potentially hundreds of others who bought and ate beef from a batch that was ultimately recalled and linked to a slaughtered Yakima Valley Holstein.
In her suit, Crowson contends that QFC had the "means and ability" to contact her and other customers who unwittingly bought the beef by tracking purchases through QFC Advantage Cards.
Crowson's suit claims QFC neglected to do that -- at least not until after she learned through a news story in January that QFC had carried the beef, and then called the company on her own to have her purchases traced.

The suit contends the family bought and later ate ground beef from their local QFC that was part of a batch processed at Vern's Moses Lake Meats on Dec. 9 and included meat from the diseased Holstein.
But the family's suit claims that, although QFC was aware of the recall on Dec. 23, the store did not begin pulling the recalled beef from about 40 of its stores that carried it until Dec. 24.
The family only learned QFC had sold any of the beef in question after reading a news story Jan. 10 about a Mercer Island man who discovered his family had eaten affected beef that he bought at a local QFC store, Crowson said.

 QFC "Advantage Card" is no Bargain
When they bought out QFC and Fred Meyer stores in the Northwest a few years back we were not surprised.
Nor were we surprised when, despite assurances that QFC would remain card-free, Kroger imposed a shopper surveillance card called the "Advantage Card" on QFC shoppers on May 1, 2002.
Of course, QFC is promoting the card as a great way to save money, but experience has taught us to take Kroger's savings claims with a grain of salt.

The lawsuit is believed to be the first stemming from this country's only confirmed case of mad cow disease, or bovine spongiform encephalopathy, which was detected in a slaughtered Holstein from a Yakima Valley ranch on Dec. 23.
Jeff Burt, QFC's vice president of marketing, said Friday that QFC has yet to receive a copy of the lawsuit, so he could not speak specifically to Crowson's claims.
Crowson later called QFC and faxed the company a signed letter asking that it track purchases made on her QFC Advantage Card -- a store discount card issued to customers.

 Overlawyered: QFC mad cow class action
In other grocery lawsuit news: you may remember back in December that a single Canadian cow was found to have mad cow disease, and as a safety precaution, tens of thousands of pounds of beef were voluntarily recalled in addition to the 10,510 pounds the USDA ordered recalled.
The filing complains that QFC wouldn't reveal to the Crowsons that the beef they purchased was recalled until after they received a written and signed request; QFC hasn't said so, but I would imagine that that requirement is a consequence of a privacy policy.
The complaint also says that "some of the meat" was consumed after December 24, a negative pregnant that suggests that the rest of the meat was consumed before QFC learned of the mad cow exposure.
