When a quorum is present on the floor, it may be easier to obtain sufficient support for a recorded vote than for a yea-and-nay vote because the number of Members present probably will exceed the minimal quorum of 218 (in which case 1/5 of the number present will exceed 44).
Only when a quorum actually is present at the time of a voice or division vote--for example, when Members have just come to the floor to cast another vote--must a Member have the support of at least 1/5 of the Members present to secure a yea-and-nay vote on the same question.
Note that the purpose of a quorum call under subparagraph (1) or a call of the House under subparagraph (2) is to secure the presence of a quorum, not to require the attendance of all the Members of the House.

as andrew gill pointed out, the senate rules essentially give a presumption that there is a quorum unless there is a quorum call.
while, on it's face, it seems a little ludicrous to assume there is a quorum of 51 senators when there are only three people in the room, it's apparently worked that way for a while.
but given how well established this quorum call procedure is, and the fact that neither i nor commenter matt taylor could find any case which overturned a statute on those grounds, i think a court would be a little reluctant to rule on the constitutional issue.

SENATE ROLL CALL VOTES The Senators present did not demand a quorum call (or unanimously over-rode it) and did not call for a roll call vote.
And as to your "The senators not present did not deem it important enough to block it comment", that is completely ridiculous because the fact of the matter is that this was passed late on a Sunday and I'm almost 100% sure the Senators present didn't bother to notify the ones not present.
All it would have taken to demand a quorum be present is one objector to object to the absence of quorum.
