In the News (Fri 17 Feb 12)

  4. The Protection of Technological Measures (Section 226) | Recording Industry Association of New Zealand | ...
RIANZ suggests that the preferred approach in New Zealand should be to follow that taken in the European Union and the United States by extending section 226 to cover both access control technology and the act of circumvention.
RIANZ urges that the Ministry does not adopt a policy position that would provide an exception to section 226 of the Act and allow the manufacture and offer for sale of circumventing devices, the provision of information on circumvention or the undertaking of circumvention itself in order to enable users to benefit from exemptions.
RIANZ notes that the Ministry proposes to retain the subjective knowledge requirement already established in section 226 of the Copyright Act and to introduce the same level of knowledge with respect to protection for RMI.

The Wireless: Open letter to Radio New Zealand
Never mind the fact that most (large and small) commercial, student and iwi broadcasters in New Zealand don't seem to have a problem operating in the face of the draconian RIANZ policy not to give streaming licences to any broadcaster under any circumstances for any sum of money.
RIANZ are the only game in town for 95% of all the music - and they are fixing all the rules and all the prices for the sole purpose of profit maximisation.
RIANZ *has* been negotiating, and I would think that when Campbell Smith arrives as the new CEO, things should move along more rapidly.

Regular readers will know that I have little time for Michael Gladding (he also has little time for me after this interview) and the attitudes of RIANZ when it comes to the "fair use" of music recordings that customers have paid good money for.
Surely, if Mr Gladding and the RIANZ believe that it's okay to format shift then they must also support changing the law so that such actions are no longer illegal -- but they don't support such changes and predict all manner of horrible repercussions.
At the end of it, I came away thinking -- the RIANZ still doesn't have a clue in respect to dealing with changing technology or treating their customers like valuable assets rather than criminals.
