The 300 seats in the National Assembly were up for election.
The only authority of the National Assembly was to accept or reject amendments which were proposed almost unanimously by the Legislative Yuan in August 2004, one of which was to abolish the National Assembly.
The parties supporting the amendments won 249 out of a total of 300 seats, compared to the opposition's 51 seats, which was enough to ensure that the constitutional amendments were passed by the elected National Assembly.

In May of 2005, a new national assembly was elected to reduce the number of parliamentary seats and implement several constitutional reforms.
The ROC begun its implementation of a force reduction program to scale down its military from a level of 430,000 in the 1990s, and is drawing to a close by 2005.
Originally the unicameral National Assembly, as a standing constitutional convention and electoral college, held some parliamentary functions, but this has now become a non-standing body of 300 members that has seen most of its powers transferred to the Legislative Yuan.

Elections for representatives of the Republic of China's fourth National Assembly officially kicked off after 12 groups submitted their lists of candidates to the Central Election Commission (CEC) March 30.
According to the ROC Constitution, political parties or community groups with no fewer than 20 members can each field a list of candidates to compete for seats in the assembly, whose members are elected on the basis of proportional representation won by all participating groups.
The assembly representatives, to be elected May 14, will need to convene within 10 days of the CEC announcing the election results and complete its review and endorsement of the package of amendments.

As a result, the Judicial Yuan decided that the original members of the National Assembly would continue to hold office until the Communists could be defeated on the Mainland and legitimate ROC rulership of all of China restored.
