In contrast to the elections of 1996 and 2000, the PRC was quiet in this election until early November.

The Legislative Yuan is one of the five branches (called 'yuàn', meaning 'courts'; compare: Spanish Cortes) of government stipulated by the Constitution of the Republic of China, which follows the San-min Chu-i (political theory of Sun Yat-sen).
The Legislative Yuan greatly increased its prominence after the 2000 Presidential elections in Taiwan when the Executive Yuan and presidency was controlled by the Democratic Progressive Party while the Legislative Yuan had a large majority of Kuomintang members.
The legislative elections in late 2001 produced a contentious situation in which the pan-blue coalition has only a thin majority over the governing pan-green coalition in the legislature [1], making the passage of bills often dependent on the votes of a few defectors and independents.

There were accusations in the ROC presidential election, 2004 that the KMT retained assets that were illegally acquired, and in any case, the KMT retains large properties throughout Taiwan.
However, the fortunes of the party were greatly improved when the KMT did well in the ROC legislative election, 2004 held in December 2004 by maintaining its support in southern Taiwan achieving a majority for the Pan-blue coalition.

The DPP attempted to portray the Lien-Soong ticket as one which would sell out Taiwan to the PRC, and emphasized constitutional reform, proposing a new constitution, and a "peace referendum." This was rejected by the High Court on November 4, 2004, but the Pan-Blue coaltion is appealing to the Supreme Court.
