  Settlement Agreement - Between The United States of America and Advocate Ravenswood Hospital Medical Center
Ravenswood is a "public accommodation" as defined in section 301(7)(e) of the ADA, 42 U.S.C. § 12181, and its implementing regulation, 28 C.F.R. § 36.104.
Ravenswood shall not deny its goods or services to anyone based on the fact that the person is deaf or hard of hearing or is associated with someone known to be deaf or hard of hearing.
Ravenswood will annually conduct one or more training sessions on the communication and psychological needs of persons who are deaf or hard of hearing or who have speech impairments, and will invite all physicians who are affiliated in any way with the Hospital (admitting or surgical privileges, etc.) to attend.

Many hospitals go to great lengths to define the relationship between an ED physician and the hospital as one that is not of employer-employee status.
Under these conditions, a contract exists between the hospital and the physician group, the doctors oversee and operate the department, the doctors provide their own insurance, and the patient had no choice in physicians (in this case, a radiologist, but the tests are equally applicable to EM physicians).
In this case, the physician was accused of a conscious disregard for the patient's safety in failing to transfer her to a hospital for treatment.

Chicago police officers, frustrated with the hospital personnel's inaction and the wait for an ambulance, removed a wheelchair from the ED and used it to wheel the lifeless boy into the ED.
We also understand staff's obligation to provide a medical screening examination to anyone who comes to the hospital and to give stabilizing treatment to those with emergency medical conditions.
