Topic: Repeal

In the News (Mon 16 Nov 09)

Repeal - Wikipedia, the free encyclopedia
A repeal is the removal or reversal of a law.
The union was partially repealed in 1922, when under the Anglo-Irish Treaty of 1921, twenty-six of the thirty-two Irish Counties became the Irish Free State and ceased to be part of the United Kingdom.
Some repeals are of extremely old and outdated laws that now seem bizarre, such as one from the 19th century against bathing.

Repeal of Prohibition in the U.S.
Repeal of Prohibition in the U.S. by David J. Hanson, Ph.D. National Prohibition in the United States had been viewed by tens of millions of Americans as the solution to the nation's poverty, crime, violence, and other ills and they eagerly embraced it.
The popular vote for repeal of prohibition was 74 percent in favor and 26 percent in opposition.
Therefore, despite the repeal of prohibition at the national level, 38 percent of the nation's population lived in areas with state or local prohibition.

Repeal would be expensive, however: immediate repeal would reduce revenues by over $400 billion over the next decade.
Repeal would also be regressive, would reduce charitable giving by over $15 billion a year, and would invite significant tax sheltering.
In contrast to repealing the tax, retargeting the estate tax to very wealthy households and lowering its rates would blunt much of the criticism against it while retaining many of its advantages.

Lower-Cost Estate Tax Repeal Reflects Slow Phase-In
Supporters of estate tax repeal often point to the complexities of current estate planning as a rationale for repealing the tax, yet the backloaded approach taken by the Ways and Means Committee would add to this burden over the next decade rather than reduce it.
Because under the Ways and Means bill the cost of repeal would not occur until the very end of the initial ten-year period, the $186 billion revenue loss resulting from the bill over the first ten years includes little of the revenue loss resulting from income tax avoidance that would ultimately occur.
We estimate that, even if such provisions were in place before repeal takes effect, the cost in the second ten years would still be between $1.3 trillion and $800 billion — with the lower end of the range requiring extremely effective measures, casting doubt on whether such a low estimate is feasible.

With the exception of South Carolina, where voters chose a full slate of at-large delegates opposed to repeal, and Indiana, where one-fourth of the district delegates were elected on the basis of their opposition to repeal, hardly a delegate objected to ratification in the conventions.

Employees of non-profit organizations are likely to resist the repeal of the income tax for fear that people would no longer have an incentive to make contributions to their organizations.

Rose contends that a distinguishing feature of the women's repeal movement was an argument for home protection, a social feminist ideology that women repealists shared with the prohibitionist women of the Women's Christian Temperance Union.
The book surveys the women's movement to repeal national prohibition and places it within the contexts of women's temperance activity, women's political activity during the 1920s, and the campaign for repeal.

 Strategies for sodomy law repeal
Several states have simultaneously sought repeal legislation and lawsuits to strike down the sodomy laws, or have quickly switched from one to the other.
Legislative repeals in the 1990s have required strong support for gay issues in the legislature and a politically active gay community to lobby, write, call and visit legislators.
Minnesota, Missouri, North Carolina and Virginia are able to introduce repeal legislation but have thus far received only the cursory attention as the legislatures have not seriously considered their bills.

 t r u t h o u t - Senate Rejects Bush Estate Tax Repeal
The vote against repeal came after rejection of two Democratic alternatives, one that would have raised the value of assets exempt from the tax to $3 million next year and a second that Democrats said would have spared virtually all family-owned enterprises from the inheritance tax.
Sponsors of the repeal measure said they would have succeeded had they received the support of all those who earlier this year backed a nonbinding resolution on repeal or those who voted for last year's tax cut.
Critics of repeal said that given the Senate refusal to eliminate the tax, they hoped that lawmakers could move toward a compromise to lend some certainty to the tax code.

Should the United States repeal the recent tax cuts? - Sep. 23, 2003
Many economists said the question of whether repealing some or all of the tax cuts will help the economy depends largely on where the economy stands by then.
Any negative effects of repealing tax cuts could be offset, Zandi and some other economists said, by returning some of the money to the economy in other ways.
"It's entirely possible you could repeal tax cuts without injuring the economy if you did it carefully, over a period of time, while offsetting it in part by increasing expenditures you knew were coming anyway or thought desirable," said former Fed economist Lyle Gramley, now a consulting economist with Schwab Washington Research.

House GOP Proposes to Repeal D.C. Gun Bans (washingtonpost.com)
A majority of the U.S. House of Representatives is supporting legislation that would repeal virtually all of the District's gun restrictions, targeting one of the nation's most stringent handgun bans while the presidential candidates are battling over gun limits.
Supporters of gun limits said the proposed repeal shows gun backers at their most extreme and draws attention to a flip-flop by President Bush on extending a 1994 federal ban covering some semiautomatic weapons.
Although the most recent challenge to the District's handgun ban was defeated in the House in 1999 by a vote of 250 to 175, 34 members who supported the ban have signed on as co-sponsors of the Souder bill.

The existing relationship, combined with the effect of the Supremacy Clause, is guaranteed to concentrate power into the hands of the federal government with little or no hope of return.
With that, the state governments should be focusing an effort to repeal the 17th Amendment, not on passing legislation or engaging in irrelevant activities, that are more than likely useless over the long term and probably also over the short.
