Res ipsa loquitur is a legal term from the Latin meaning literally, "The thing speaks for itself".
The res ipsa loquitur mode of inferential reasoning comes into play where an accident of unknown cause is one that would not normally happen without negligence on the part of the defendant in control of the object or activity which injured the plaintiff or damaged his property.
Res ipsa loquitur tends to be an unnecessarily difficult concept for new law students to understand.

Res ipsa loquitur is a Latin term meaning "the thing speaks for itself".
It is a doctrine of law that one is presumed to be negligent if he/she/it had exclusive control of whatever caused the injury even though there is no specific evidence of an act of negligence, and the accident would not have happened without negligence.
The last element has also softened to a more comparative standard, so that if plaintiff was only 5% negligent in contributing to the accident, the minimal contributory negligence of the plaintiff won't bar a recovery.

"The inference arising from a res ipsa loquitur case may, however, be destroyed by sufficiently conclusive evidence that it is not in reality a res ipsa loquitur case.
Metropolitan Bottling Co., 26 N.J. 263 (1958), the New Jersey Supreme Court held the doctrine of res ipsa loquitur applied to a defendant bottler who had delivered filled soda bottles to a luncheonette and where one of those bottles exploded and injured the plaintiff who was an employee of the luncheonette.
The court found that even though possession and control of the bottles had been transferred to the luncheonette, there was no rational ground for imputing presumed negligence to the luncheonette where there was no suggestion of careless handling of the bottle by the luncheonette.
