BBC NEWS Scotland Poles apart in Holyrood's big top
It is a matter reserved to Westminster but Scottish ministers are participating energetically in the Home Office review.
Now everyone is off to prepare for government at Westminster, with devolved matters - health, education, crime - likely to dominate the election.
The SNP's Kenny MacAskill argued that Scotland needed urgent legislation to remove airguns and replica guns from general circulation and said we could not wait for the Westminster review which was concerned with the very different problem of guns used in professional gangland crime.

Since the establishment of the Scottish Parliament defence is a power reserved to the British Government and defence matters cannot be decided by the Scottish Parliament.
At Westminster there is a CND group of MPs and at Holyrood there is a cross party Nuclear Disarmament Group of MSPs.
Issues affected by the presence of Britain's only nuclear base within Scotland for example health and safety and the environment can be considered.

The contemporary role of the Scottish Office
As I have understood the Scottish Office was kind of splitted and the devolved powers were transferred to the Scottish Executive whereas the reserved matters were left to the Secretary of State, according to the Scotland Act of 1998.
I meanwhile learned something about devolved and reserved matters of government policy but cannot understand the role of the Scottish Office.
Or is the Scottish Office with the Secretary of State for Scotland any longer only responsible for reserved matters since the Scotland Act?

Sewel motion - Wikipedia, the free encyclopedia
It is also used when Westminster is considering legislation applying to Scotland but which relates to both devolved and reserved matters, where it would otherwise be necessary for the Scottish Parliament to legislate to complete the jigsaw.
A Sewel motion is a motion passed by the Scottish Parliament, in which it agrees that the Parliament of the United Kingdom (in Westminster) may pass legislation on a topic extending to Scotland over which the Scottish Parliament has legislative control.
It is used when Westminster is considering legislation extending only (or having provisions extending only) to England and Wales, and the Scottish Parliament, being in agreement with those provisions, wishes for Westminster to extend them to Scotland also, rather than requiring separate, similar legislation to be passed by the Scottish Parliament.

Campaigners seek Tory support for English parliament
The organisation says it does not advocate the break up of the UK and a much-reduced Westminster parliament would be responsible for defence, foreign policy and other "reserved" matters.
His constituency submitted a motion - not selected by the Conservative organisers - calling for matters relating solely to England at Westminster to be restricted to MPs representing English constituencies.
Although the Campaign for an English Parliament (CEP) is an embryonic body operating on a shoestring budget, it is a harbinger of a possible English backlash to the constitutional reforms elsewhere in the United Kingdom.

If you aren't sure who to contact, the West Edinburgh constituency office can help put you in touch with the right person.

 The 'West Lothian Question'.
The crux behind a Sewel motion is in concluding whether matters are devolved to the Scottish Parliament or reserved to the U.K. Parliament[49].
A mechanism named the Sewel convention, after Lord Sewel who contrived the system, provides a means for the Scottish Parliament to permit Westminster to legislate in devolved matters[46].
Critics of the Sewel convention, however, are not persuaded by this argument and regard it as no excuse for the Scottish Parliament not enacting the legislation itself in these areas when it has the ability to do so.

Statement by Jim Wallace to Scottish Parliament - 23 June 1999
Mr Wallace: I am sorry to disappoint Mr Canavan, but there is a clear division between the freedom of information bill regime that will be passed by this Parliament, which will apply to matters that are the responsibility of the Scottish Parliament, and the matters that are reserved.
Mrs Margaret Ewing (Moray) (SNP): In the interests of freedom of information and of the public whom we serve, will members of this Parliament be given the same rights of parliamentary privilege as members at Westminster when they want to raise individual cases here?
Mr Wallace: I want to take the opportunity to clarify one point: the code of practice that we are discussing does not apply to the police, because the police are not subject to the jurisdiction of the parliamentary commissioner for administration.

Certain matters are 'reserved' to Westminster, meaning that the Scottish Parliament is not competent to pass legislation in those areas, detailed in the Scotland Act.

The former Labour MP, Denis Canavan, won the constituency of Falkirk West as an Independent while the Scottish Socialist Party leader, Tommy Sheridan, won a seat in the Glasgow region and the last MSP to be elected was the first Green in the UK, Robin Harper in Lothian.

A letter written by a Bandon man to his brother, in a few weeks afterwards, gives us an opportunity of seeing matters as they were-or, at least, as they then presented themselves to one who was there, and saw them at that eventful period.
All the troops in Bandon and at Mammoor camp were drawn up, so as to form the three sides of a square, the fourth being reserved as the place of execution.
On the 30th of July, Sir Broderick Chinnery, of the city of Bath, was elected to represent Bandon in the new Parliament to be held at Westminster, on the 31st of August.

Mr Rumbles was instrumental in pushing the case for full fiscal autonomy as Liberal Democrat policy - giving Scotland the power to raise the money it spends and sending a portion to Westminster to pay for reserved matters.
Mike Rumbles, the MSP for West Aberdeenshire and Kincardine, spoke out about the lack of ambition among the senior members of his party and claimed they were not radical enough.
Mr Rumbles also made it clear he would cause trouble for Labour over the high- profile Anti-Social Behaviour Bill going through parliament, because he feels central parts of it are illiberal.

The UK - a new constitutional settlement?
The Scotland Act was also born, some would say, of political necessity and provides for the setting up of a Scottish Parliament which has legislative competence over many issues to the exclusion of the Westminster Parliament but not over "reserved" matters.
On 31st July 1998 the Government of Wales Act 1998 was enacted and on 19th November 1998 the Scotland Act 1998 and the Northern Ireland Act 1998 were both passed.
The Government of Wales Act 1998 is similar to the Scotland Act in some ways but gives the Welsh Assembly fewer powers than apply in Scotland and in particular includes no provision for a tax-varying power.

Welsh MPs will undoubtedly pursue their constituency interests at Westminster, in particular where these are at odds with the Assembly's.
The Welsh Assembly will also be concerned to develop external relations with the European Union in matters concerning regional grants and agricultural subsidies; with the Irish Republic in the context of the Council of the Isles; and with multi-national companies in the promotion of inward investment programmes.
For example, the Secretary of State will, at least in the sort term, continue to have a seat in Cabinet and will continue to negotiate with the Treasury the block grant for the Welsh Assembly; he will also be responsible for questions concerning the impact of reserved area issues in Wales.
