Cortez filed a motion for a downward departure, asserting that he was not aware that he could be eligible for career offender status at the time he entered the plea agreement, and that the presentence report over-represented the seriousness of his criminal history by including the seventeen-year-old conviction for distribution of marijuana.
Cortez a good-faith estimate of the potential sentence he could receive, particularly given the fact that she warned him that her opinion could be wrong and that sentencing remained in the sole discretion of the judge.
Cortez further asserts that his counsel at sentencing, Stephen Stevers, was ineffective in failing to object to the alleged error by the district court, or request that the district court apply the departure.
