Judge Richard S. Rodney has argued the Delaware Supreme Court had an independent statutory base from the Delaware Colonial Assembly.
But, when Governor Walter W. Bacon refused to reappoint Judge Richard S. Rodney, many advised Pearson that he had no choice since it was necessary to have an experienced judge not only in the Superior Court but also in Chancery appeals and other appeals in the Supreme Court.
Fortunately for the State, Judge Rodney's enormous judicial talent was saved by his appointment to the United States District Court.
