Richard Michael Simkanin is a tax protester convicted in United States federal court of tax evasion in 2004.
Simkanin had appeared in an advertisement in USA Today in which he announced that he had not withheld income taxes from the paychecks of his company's employees because he believed the income tax to be voluntary.
Simkanin was sentenced to 84 months in federal prison.

Simkanin testified that the Bible told him that God is entitled to the first fruits of a person's labor and that if he withheld taxes from his employees, then he was stealing the first fruits of their labor.
Simkanin does not specifically identify all of the evidentiary rulings that he claims were erroneous; rather, he advances a broader contention that the district court's evidentiary rulings as a whole prejudiced his ability to assert his defense.
Simkanin avers that the district court's evidentiary rulings were not evenhanded because it permitted the government to introduce §3402 as proof that Simkanin had been shown, and therefore actually was aware of, the correct law concerning withholding.

Simkanin primarily attempted to establish that he did not willfully violate the tax laws because he held a good-faith belief that he was not obligated to pay individual income taxes or to withhold employment taxes from the wages paid to Arrow's employees.
Simkanin stated that because Arrow did not operate in any of the listed industries or perform any of the listed activities, he concluded that Arrow's workers were not employees under the IRC and that he therefore was not required by law to withhold taxes.
Simkanin's last argument with respect to his conviction is that the district court unfairly and arbitrarily excluded defense evidence and restricted the scope of cross-examination, thus hampering the presentation of his good-faith defense.

Simkanin's attorney had reserved several minutes for which to rebut the governments arguments, which he did, focusing not only on Dick's unfair trial but also on his excessive and illegal sentence.

In the caption of the case, the terms RICHARD MICHAEL SIMKANIN is of course a legal fiction, or debtor, and the real man Richard Michael Simkanin is the creditor.
Since the "courts" appear operate in commerce or a form of law merchant, they need the evidence from the defendant himself to proceed.

Assuming that the Sixth Amendment will still be operational when his trial comes up, perhaps Simkanin will subpoena Everson to testify on his behalf as an expert witness.
Better yet, maybe the Ft. Worth grand jury that indicted Simkanin should consider indicting Everson for falsely and fraudulently representing to the American people that the federal income tax is based on “voluntary compliance.” At the very least, shouldn’t the feds go after him for violating “truth in advertising” laws?
