Topic: Right of conquest

Right of conquest - Wikipedia, the free encyclopedia
The right of conquest is the purported right of a conqueror to territory taken by force of arms.
Its defenders state that the acknowledgement of this right is simply an acknowledgement of the status quo, and that denial of the right is meaningless unless one is able and willing to use military force to deny it.
Someone appealing to the right of conquest was most likely planning on standing as regent, rather than just robbing a land of its riches (like the Vandals and Mongols are regarded as having done).

WorldNetDaily: What about Israel's 'right of conquest'?
One controversial notion connected to this ongoing conflict is whether or not the state of Israel has a "right of conquest" to its land.
The United States has a right to its current territory not because we have some legal or historical claim to this land superior to that of the Indians -- we don't -- but rather because there is no force on earth, at the moment, capable of forcing us to give it back.
Even if we agreed that Israel deserves its land because of historical reality or the "right by conquest," the bottom line is that it has to give up land for some kind of peace.

This is not a fashionable thing to say, but the validity of the right of conquest is an essential foundation of world order and should be respected.
Right of conquest is, de facto, a settled and accepted part of international law and political practice.
The fact that we recognize conquests after the fact does not remove the fact that they are bloody, inhumane, and violate previously recognized sovereignties.

Burlamaqui: The Principles of Politic Law: Part IV Chap. VIII
We have already remarked, that when explaining the different ways of obtaining the supreme power, that in general it may be acquired either in a violent manner, and by the right of conquest, andc.
We must however observe, that war or conquest, considered in itself, is not properly the cause of this acquisition; that is, it is not the immediate origin of sovereignty.
These maintain, that in a just war the victor acquires a full right of sovereignty over the vanquished, by the single title of conquest, independently of any convention; and even though the victor has otherwise obtained all the satisfaction and indemnification, he could require.

According to this right, as we find in the fourteenth chapter of Genesis, Abraham devoted to God a tenth part of the spoils, which he had taken from the five kings: and the inspired writer in the seventh chapter of his Epistle to the Hebrews gives the same interpretation of this passage.
Nor is it upon conjecture alone that such a right is founded, but the divine law giver himself pronounces sentence against a city that has rejected the offers of peace, and afterwards been taken by storm, that he gives all her spoils to the conqueror.
But considering the rights of the sovereign, to whom that territory belongs, he undoubtedly has a right to forbid the seizure of persons, or the capture of things within his own dominions: and may demand satisfaction for the violation of that right.

This is an enquiry into the place of the right of conquest in international relations since the early sixteenth century, and the causes and consequences of its demise in the twentieth century.
It was a recognized principle of international law until the early years of this century that a state that emerges victorious in a war is entitled to claim sovereignty over territory which it has taken possession.
Her conclusion, which highlights the merits and defects of the modern law as a vehicle for discouraging war by denying the title to the conqueror, challenges many of the assumptions that have come to constitute part of the conventional wisdom of our times.
