Robert Alexy's classic work, available now for the first time in English reconstructs the reasoning behind the jurisprudence of the German Basic Law and in doing so provides a theory of general application to all jurisdictions where judges wrestle with rights adjudication.
In the first one, Alexy studies the concept of a general legal theory about the fundamental rights of the Basic Law (1949), and he does distinguish between the theory and the theories of fundamental rights and he defines his theory as a structural theory.
Alexy in which the author "reconstructs the reasoning behind the jurisprudence of the German Basic Law and in doing so provides a theory of general application to all jurisdictions where judges wrestle with rights adjudication" (Oxford University Press).

Robert Alexy, accepting the way in which Dworkin characterizes the distinction between rules and principles, has pointed out that one should ask oneself why rules and principles intersect in different ways.
According to Alexy, principles are norms which estsablish that something be carried out to the greatest possible degree, in relation to legal and factual possibilities.
According to Alexy, this explanation of the distinction between rules and principles is not incompatible with that of Dworkin, rather it goes one step further: the difference between the two types of standards referred to by Alexy would explain the reason for the differences referred to by Dworkin.

Herget's explication of the theoretical tenets of Robert Alexy and Jürgen Habermas is accurate enough, but his critical evaluation of them departs from his generally cool, detached, and thoughtful mode of procedure.
For instance, he appears to deliberately misapprehend the linguistic underpinnings of discourse theory when he states that, ‘the insistence on rational argumentation seems to be dictated more by the preferences of the discourse theorists than by any presupposed rules of language' (55).
This ignores the very arguments of Alexy and Habermas concerning the mutual understanding necessarily taken for granted in any act of speech that Herget himself recapitulates in the pages proceeding his remark.
