Howe was forced to retreat to Savannah with a shattered command, with which, and a small militia force, he endeavored to defend the city against the British under General Provost; but, being surprised in the night by Lieutenant-Colonel Campbell, was forced to evacuate the place.
Although he was honorably acquitted by a court-martial, Howe's conduct was severely criticized, especially in a public letter by General Christopher Gadsden, of Charleston, whom Howe at once challenged.
Howe's ball grazed Gadsden's ear, and the latter fired in the air, after which the combatants became reconciled.

On the 9th, the same day Washington was holding a Council of War, General Howe learned from scouts and spies that Washington had several thousand men massed along the east side of Brandywine Creek, with the bulk of the army dug in at Chadd's Ford.
Howe decided to repeat the flanking strategy that was successful for him at Long Island and hope that Washington would discount the possibility this time, as the flanking movement here would be far more ambitious.
Their mission was to convince Washington that the entire British army was attacking at Chadd's Ford, and to give Howe and Cornwallis enough time to move their troops into position on the east side of the Brandywine.

In a special verdict, the jury held that Howe did not violate Foote's Fourth Amendment rights when he stopped her vehicle, nor did he violate her constitutional rights when he detained her at the scene of the stopping to investigate whether she was driving under the influence of marijuana.
Howe called in Spiegel, who was a "drug recognition expert," to assist him, and Spiegel arrived on the scene some time after Howe made the stop.
It was uncontroverted that when Spiegel arrived, Howe related to Spiegel that he had detained Foote because she drove erratically and had bloodshot eyes and slow speech, and because of the results of the two eye tests.

He was born in Wallingford, Dec. 26, 1921, the son of the late Joseph L. and Katherine O'Connell Howe and had been a lifelong Wallingford resident until moving to Cape Coral, Fla., in December of 2004.
He was a U.S. Navy veteran of World War II, and had been employed as a Crew Chief for the Wallingford Department of Public Works for 36 years, and later by Double A Transportation in Wallingford.
Howe was a parishioner of Our Lady of Fatima Church and was a member of the Veterans of Foreign War, Lufbery Post No. 591.
