Mawdsley describes the Miller trial as a close case which could have easily ended with a jury finding him not guilty.
Mawdsley had ordered a 13-year prison term but the judge declared during the July 2000 sentencing hearing Miller was not a risk and legal questions raised during the appeal would warrant the delay.

Mawdsley gave Miller a three-year sentence, which called for two years behind bars because the alleged offense took place before Wisconsin enacted truth-in-sentencing laws, Shellow said.

Circuit Court Judge Ralph Ramirez recused himself from the case this week because he worked in the Waukesha County district attorney’s office during the 1990s while Miller was being investigated.
