Carey’s court victory is also a vindication of the movement to chase Hoffa out of union office and democratize the union.

Carey may be held strictly accountable for violations in the course of the campaign, and as a consequence has suffered nullification of his campaign victory, it does not necessarily follow that disqualification would constitute a proper exercise of discretion in the present circumstances.
Carey should be disqualified from the rerun election implicates the very heart of the federal government's sometimes paradoxical role in encouraging the development of unfettered union democracy on the one hand, and protecting the resources and institutions of rank and file members from the corrupt abuses of its leadership on the other.

 Former Teamsters President Ron Carey indicted for perjury
Carey is charged with lying to federal officials in 1997 when they were investigating the transfer of nearly $1,000,000 in union money to a number of pro-Democratic Party liberal organizations as part of a scheme in which these organizations were to kick the money back to the Carey campaign.
Carey pleaded not guilty to the charges in district court in Manhattan on February 2 and was released on his own recognizance after surrendering his passport and all travel documents.
Carey is charged with making dozens of false statements to federal investigators relating to a plan to donate $885,000 in Teamster funds to four political groups—including $475,000 to Citizen Action—which in turn were to line up matching donations to the Carey campaign through third-party contributors.

The purging of Carey and the charges against his allies in the AFL-CIO leadership are the retaliation of the Clinton administration and the capitalist state, aimed at undermining this leadership and suppressing a resurgent trade union movement.
Carey did nothing to defend scores of strikers who were victimized and fired, and he offered no resistance when UPS announced it planned to fire thousands of workers in retaliation for the walkout.
Michael Ansara, one of the chief protagonists in the Carey scandal, is an exemplary representative of this social layer.

NEW YORK (CNN) -- Former Teamster President Ron Carey was indicted Thursday for allegedly committing perjury and making false statements during the investigation of a fundraising scandal that led to his downfall as head of the nation's largest private sector union.
Carey, 64, who took charge of the union as a reform candidate pledging to clean up its long history of corruption, won re-election in December 1996 by narrowly defeating James P. Hoffa, the son of legendary Teamster boss Jimmy Hoffa who disappeared in 1976, the apparent victim of an underworld hit.
Carey was the first Teamster president in the union's history to be directly elected by the union's rank and file.
