Topic: Roundup Ready Canola

Biotech Basics - Achievements in Plant Biotechnology - Roundup Ready® Canola
Roundup Ready® canola may allow growers to seed earlier; use higher yielding, later maturing varieties; and potentially enjoy a wider window for herbicide application.
Roundup Ready® canola was planted on 58 percent of the total Canadian acreage devoted to herbicide-tolerant canola last year and 38 percent of total canola acreage (herbicide-tolerant and conventional).
Currently, the Roundup Ready® trait is not available in hybrid canola, so developing hybrids with the trait is an important RandD goal that, when accomplished, could enable growers to obtain even greater benefits from the product.

Monsanto Canada Inc. v. Schmeiser - Wikipedia, the free encyclopedia
The biotechnology company Monsanto developed a glyphosate-resistant gene for the canola plant which has the effect of producing canola that is resistant to their Roundup brand of herbicide.
Roundup Ready Canola was introduced in Canada in 1996, and by 1998, it accounted for 25% of the country's canola area.
In 1997, Percy Schmeiser, a canola breeder and grower in Bruno, Saskatchewan, discovered that a section of one of his fields contained canola that was resistant to herbicide Roundup.

AMSQ - Roundup Ready Canola, resistant to glyphosate   (Site not responding. Last check: 2007-10-01)
The Roundup tolerant gene comes from certain micro organisms which are found in the soil and which have the ability to damage glyphosate.
Application is made between the emergence and the 6 leaf-stage of the canola (ideally at the 2-3 leaf stage) when most of the weeds have germinated.
It is necessary to clearly identify the fields or parts of fields which are sown with Roundup Ready canola in order to use the appropriate herbicides in each of the fields.

Monsanto claims that in 1998, Schmeiser planted 1,030 acres with seed from his 1997 canola crop containing a gene or cell that was protected by Monsanto’s 1993 (see February 23, 1993) patent on glyphosate-resistant plants and that he did so without permission from Monsanto.
Plaintiff Argument--Schmeiser used Roundup on his 1998 crop - In an effort to prove that Schmeiser’s 1998 crop consisted mostly of Roundup Ready Canola and that Schmeiser sought to take advantage of its resistance to the herbicide, Monsanto cites the testimony of Wesley Niebrugge, a farmer and employee of the Esso bulk dealership in Bruno.
Curious about the possibility that his canola plants may have developed a resistance to Roundup, he sprayed a trial strip about 100 feet wide in one of the fields that is next to the road.

A canola plant that survives being sprayed with Roundup is Roundup Ready Canola.
Schmeiser planted canola seed saved from his 1997 crop in his field number 2 which he knew or ought to have known was Roundup tolerant, and that seed was the primary source for seeding and for the defendants’ crops in all nine fields of canola in 1998.

Monsanto Vs Schmeiser - Percy Schmeiser
In the summer of 1998 Schmeisers the canola in Schmeisers fields was found to be Roundup Ready canola.
Monsanto claimed that Schmeiser planted Roundup Ready Canola in his fields intentionally, though they later said they could offer no evidence for this, and that it was possible for natural pollination to have caused Roundup Ready Canola to grow in Schmeisers field.
Based on Schmeisers account of events surrounding the appearance of Roundup Ready canola in his 1998 crop, the court found that he had either known or ought to have known that he had planted Roundup Ready canola in 1998.

It is also important to consider carefully the evidence regarding purity of the 1998 crop with respect to Roundup Ready canola because if our results are taken to be correct (and there was no argument against their validity in the original case or the appeal) then they show that Mr.

It is also important to emphasize that it is reasonable to draw lessons from Roundup Ready canola without necessarily passing judgement on the net benefits of that particular crop.
The case of Roundup Ready wheat is quite different from both a market and agronomic perspective, and it would be inappropriate to conclude that, if Roundup Ready canola was a net benefit to farmers, then Roundup Ready wheat must be as well.
Furthermore, feedback from the CWB discussion paper, “An Agronomic Assessment of Roundup Ready Wheat” indicates that many agronomy research scientists and field agronomists are, at best, cautiously neutral, while the majority of farmers are skeptical, regarding the potential benefits Roundup Ready wheat for Western Canadian agriculture.

On March 29, 2001 a trial judge found Schmeiser to have committed multiple infringements of Monsanto’s patent and fined him $20,000, asserting that the levels of Roundup Ready Canola on Schmeiser’s property were such that he “knew or ought to have known” that his crop was planted with Roundup-ready seeds.
Schmeiser grew canola on his property on Field Number One, the seed which was the subject matter of Monsanto’s allegations could be traced to this 370 acre field on Mr.
The subsequent conduct of farmers upon discovering the existence of Roundup Ready Canola in their fields will be more determinative of their legal liability than the mere factual existence of the crop on their property (Paragraph 95).

Schmeiser insisted that any Roundup Ready growing on his land was spread by wind or by grain trucks travelling on roads adjacent to his fields.
In defence, Schmeiser presented his own farm-based evidence, that the fields ranged from nearly zero to 68% Roundup Ready, which was confirmed independently by research scientists at the University of Manitoba, Winnipeg.
In a key part of the ruling, the judge agreed a farmer can generally own the seeds or plants grown on his land if they blow in or are carried there by pollen; but this is not true in the case of genetically modified seed.
