Justice Ruma Pal, who had recalled the order after it was smuggled out of her court yesterday before it had been signed, today accepted the “unconditional apology” and “explanation” offered by Ravindra Narayanan, one of the ITC counsel.
Justice Pal and fellow judge — Justice P. Venkatrama Reddi — chose not to alter the verdict, operative portions of which were read out in court yesterday.

New Delhi, Sept. 10: After the high drama on Thursday, the Supreme Court restored its judgment in the ITC excise case, quashing the Rs 803 crore tab that the government had slapped on the Calcutta-based cigarette-to-hotels giant.
Narayanan had said the 40-page court order — which the ITC counsel had wanted to read in the courtroom — had “inadvertently” got entangled with other case papers and had been carried out of the court when he rushed to attend to other legal matters.
The bench made no mention of the application filed by counsel Narayanan tendering an “unconditional apology" and a plea not to penalise the client for his “inadvertent” mistake in taking the order out of the courtroom.

The March 6 judgment punished Arundhati Roy for having criticised the judgment given by Justices Pattanaik and Ruma Pal on August 28, 2001 on another contempt case against her.
Justices Pattanaik and Ruma Pal dismissed the charges against the three but found Arundhati Roy prima facie guilty of contempt of court for having made certain "derogatory" averments in her affidavit.

But Diwan pointed out to justice Pal that, in a related case of the company, her husband S Pal had appeared on behalf of S Sarker, the counsel for respondent All India Shaw Wallace Employees' Federation who was made a party in that case.

Keeping in mind the admission of the Union Government that failures in sterilisation operations attract huge criticism, a Bench comprising Justice Ruma Pal, Justice Arijit Pasayat and Justice CK Thakker laid down the experience criteria for doctors while hearing a public interest petition filed by Ramakant Rai.
The court took note of the fact that there were no uniform guidelines followed by the states in conducting sterilisation operations and ordered that the Union Government would, within four weeks, formulate uniform qualification criterion for empanelment of doctors.

If the termination of a person's job during the probation period was without any reason, perhaps such an order would be sought to be challenged on the ground of being arbitrary, the bench said.

The society has also sought permission to perform certain rituals in medieval monument as well as demanded that certain fraction of the fee collected from the tourist visiting Taj Mahal be given to them.

New Delhi: Tobacco giant ITC Ltd today (Sep 10, 2004) won a big relief in the Supreme Court, which set aside a demand of Rs 8.03 bn slapped on the cigarette manufacturers by the Government on account of alleged evasion of excise duty.
A two-judge Bench headed by Justice Ruma Pal, which had warned yesterday that taking the judgement out of the courtroom would prove costly, today came and pronounced the judgement allowing ITC's petition and dismissing the petition filed by the Commissioner of Central Excise.
No mention was made by the Bench, of which Justice Reddi was also part of, about the application filed by the concerned advocate requesting the Bench to accept his sincere apologies and not to penalise the client for his "inadvertent" mistake in taking the judgement out of the courtroom.
