If SBVT were classified as a PAC, $135,000 of the $158,750 it raised by June 30th would have been deemed illegal.
The complaint cites press accounts in which SBVT officials say the group was founded in response to Kerry’s candidacy and an ad the group has produced was made to influence the election.
SBVT could not be reached for comment at press time.

In the 60-second TV ad, members of SBVT are presented as men who "served with John Kerry." None of the veterans featured in the ad served on either of John Kerry’s two swift boats (PCF 44 and PCF 94).

The website for SBVT was registered on April 14, 2004, under the name of Lewis Waterman, the information technology manager for Gannon International, a St. Louis company that has diversified interests, including in Vietnam.
A spokeswoman for SBVT, Jennifer Webster, said "it was an effort to make sure we were doing everything legal, that's why you hire a lawyer." Webster said Ginsberg was sought out because he had worked on election law and had worked with the Republican National Committee.
While the SBVT ad and official statements by the group correctly claim only that the speakers "served with" Kerry, not that they were on the same boat, the distinction was lost on others.

There were the Annenberg Election Survey numbers, of course, on how many voters had heard of the the SBVT charges (more than half the country) and found them somewhat or very believable (46 percent of the group that had heard of the charnges).
But, as numerous observers have pointed out, outside of the ranks of partisan Republicans almost all of these "believers" were those that found the charges "somewhat", rather than "very", believable, indicating little more than a willingness to consider the charges rather than a firm belief they are true.

I suggested two specific items: SBVT claims that Kerry is lying when he claims to have been in Cambodia during Christmas 1971 and SBVT add #2 about Kerry's Congressional testimony.
I wanted to begin with the Cambodia issue because it is beyond dispute that what SBVT say in the book (Kerry was not in Cambodia in Chistmas 1971) is true while what Kerry said on the Senate floor (he was in Cambodia in Chistmas 1971) was not.
