  Society of Composers, Authors and Music Publishers of Canada (SOCAN)
SOCAN was formed as the result of a merger of CAPAC (Composers, Authors and Publishers Association of Canada Limited, founded 1925 as CPRS-Canadian Performing Rights Society) and PROCAN (Performing Rights Organization of Canada Limited, founded 1940 as BMI Canada Limited).
SOCAN's operation is overseen by a board of directors elected every 3 years by the society's members, the board comprising 9 songwriter/composers and 9 music publishers.
SOCAN has reciprocal agreements with similar societies in more than 100 countries, each responsible for administering performing rights in the world's repertoire of copyright musical works and forwarding those royalties to international societies for distribution to their domestic members.

SOCAN is a collective, administering performing rights according to the distinctive treatment accorded to it in the Canadian Copyright Act.
SOCAN had about 47,600 members in 1991, comprising 39,800 writers (songwriters, composers, lyricists) and 7,800 music publishers, who assign the performing rights in their copyright works to SOCAN to enable the society to collect and distribute royalties on their behalf.
The senior officers at the time of the founding of SOCAN were Jan V. Matejcek, chief executive officer and former president and general manager of PRO Canada; and Michael R. Rock, chief operating officer and former general manager of CAPAC.

As SOCAN does in the area of performing rights, reproduction rights agencies also sign mutual representation agreements with similar collectives in other countries, thus enabling Canadian writer, composer and publisher members to benefit from the reproduction of their works in foreign jurisdictions.

SOCAN shall have the right to audit the licensee's books and records, on reasonable notice and during normal business hours, to verify the statements rendered and the fee payable by the licensee.
No later than January 31, 2007, the licensee shall file with SOCAN a report showing the number of hotel/motel rooms in the establishment and the actual amount paid by guests for the services during 2006 and an adjustment of the licence fee shall be made accordingly.

SOCAN will argue this week that there should be a tax on cellphone ringtones to compensate recording artists for the use of their work.
SOCAN – the Society of Composers, Authors and Music Publishers of Canada – is the organization that lobbies for copyright protection on behalf of songwriters.
SOCAN is hoping to collect 10 per cent of the country's ringtone revenue, with a minimum tax of 20 cents on each tone.

SOCAN's Tariff 2.A, which relates to commercial broadcast television, was dealt a serious blow in 1998, when the Copyright Board reduced the rate to 1.8 percent of stations' gross income, retroactive to Jan. 1, 1997.
SOCAN projects that this will result in additional revenues of nearly $5.3M, a significant portion of which will be received this year.
SOCAN naturally objected to this gross attack on music creators' livelihoods, each year asking the Board to abolish, or minimize the impact of, the MBL.

SOCAN’s proposal calls for a minimum annual royalty fee of $12 per room – a fee that would add up to more than a quarter of a million dollars each year for the largest hotel companies.
In a previous meeting with SOCAN, the hospitality industry suggested that a simpler alternative would be to apply this royalty at the source, collecting this additional fee from the businesses that supply pay-per-view services.
SOCAN is also seeking a new royalty fee for any pay audio service with music in a guest room.

Legal experts say the Supreme Court has been looking for a case like the one involving SOCAN and the ISPs because they will be able to clarify several key issues involving Internet use in Canada by ruling on a narrow technical question involving some technology ISPs use to speed up performance of their networks.
SOCAN had originally asked the Copyright Board of Canada to impose a royalty on Canadian ISPs but the Copyright Board ruled that ISPs ought to be granted an exemption from paying royalties because they were, like telephone companies, simply a carrier or transmitter of the music files.
SOCAN is proposing that ISPs pay a royalty of 25 cents per subscriber per year as well as 10 per cent of any gross profit ISPs make through the sale of advertising.
