On the normal katana, the outward curved side of the blade is sharpened, while the inward curved side of the blade is blunt.
However, the sakabato is made so that the cutting edge is on the reverse side of a normal katana.
The sakabatou was used primarily by pacifistic or dishonored samurai who had taken a vow to protect but not to take life.

Well, a sakabato would be pretty interesting to forge.
An interesting note is Kenshin's sakabato has an iron sheath, just showing that Nobuhiro Watsuki is a good mangaka but not exactly a historical or weapons expert.
Geez, that sakabato must be pretty damn heavy to carry.

I read something in my RK Novel about something called Yahiko No Sakabato.
Yahiko no Sakabato is a manga short that has been scanslated.
It takes place several years after the last Kenshin arc and focuses on Yahiko (obviously) and how he uses what he has learned from Kamiya Kasshin-ryu.

A quick search for sakabato in google will show that (in the opinion of most sword experts) a sakabato is not only historically unknown but also an unsound weapon because a blade on the wrong curve of a sword that long would create sword-breaking tensions.
And the sakabato should be a bludgeoning or slashing weapon (depending upon which edge is used) but the reverse edge is definitely shown as bludgeoning both in the manga and the anime.
I agree with the penalty to using the sword as a lethal weapon.

With no force use Maul doesn't stand a snowball's chance in hell, unless Kenshin has serious problems adapting to using a lightsaber instead of a sakabato, and even then Maul will probably get schooled.
Lets me rephrase that: No Warsie Copout Forcetricks (IE: Oh, he knows EVERYTHING Kenshin will do, and hour before Kenshin does it!
