Same-sex marriage in the United States - Wikipedia, the free encyclopedia
The same political and legal events also gave rise to a counter movement to freeze the status quo by legally defining traditional marriage, the marriage of one woman to one man. This would have the effect of excluding non-heterosexual families from the legal protections of marriage.
For instance, they would argue that couples that were genetically of the same gender either as the result of intersex status or a previous sex reassignment surgery of one of the spouses have had their marriages invalidated.
The judge ruled that restricting the institution of marriage to opposite sex couples "is not rationally related to any legitimate or compelling state interest." As of October 3, 2004, the ruling is stayed pending an appeal to the state Supreme Court.

Same-sex marriage in the Netherlands - Wikipedia, the free encyclopedia
These were meant for same-sex couples as an alternative to marriage, though they can also be entered into by opposite-sex couples, and in fact about one third of the registered partnerships between 1998 and 2001 were of opposite-sex couples.
For the law, registered partnerships and marriage convey the same rights and duties, especially after some laws were changed to remedy inequalities with respect to inheritance and some other issues.
The rules about nationality and residence are the same as for any other marriage in the Netherlands: at least one partner must either have Dutch nationality or reside in the country.

 Same-Sex Marriage--Challenges and Responses
No one may marry a close blood relative, a child, a person who is already married, or a person of the same sex.
In the same way, it simply is not relevant that the same objection has been used to deny both interracial and homosexual marriage.
In the same way, the natural tie of marriage to procreation is not nullified because in some individual cases children are not intended or even possible.

Same-Sex Marriage for Transsexuals? - Why it's legal in Texas, but not California. By Brendan I. Koerner   (Site not responding. Last check: 2007-10-21)
In the 1999 Texas decision, a state appeals court invalidated the marriage between a deceased man and his male-to-female transsexual widow, after the widow tried to sue her husband's employer for wrongful death.
The unintended consequence of that decision, however, is that a transsexual could marry someone of the same gender in Texas.
After all, if a male-to-female transsexual is legally a male in the state, regardless of her surgery and appearance, then she is free to marry another female.

FindLaw's Writ - Grossman: Are Bans on Same-Sex Marriage Constitutional?
Having held that the legislature intended to prohibit same sex couples from marrying, the judge went on to consider whether such a ban violates the New Jersey constitution.
The court concluded that the right to marry is fundamental, but the right to marry someone of the same sex is not.
It saw how odd it would be for a state to promote (or at least enable) gay parenting, and at the same time, to deny those children the benefits, in terms of "family stability and economic security," of growing up in a marital home.

HOMOSEXUAL (SAME-SEX) MARRIAGES - All sides to the issue
It was only after the civil war that African-Americans were allowed to marry in all areas of the U.S. It was only after a U.S. Supreme Court decision in 1967 that mixed race couples could marry anywhere in the U.S. But, until recently, same-sex couples could not marry anywhere in the world.
This final restriction was lifted during 2001-APR, when Holland expanded its definition of marriage to include both opposite-sex and same sex couples.
Heterosexual couples who plan to marry in the future would find that nothing is changed; the regulations, privileges, obligations, benefits etc would be the same as always.

Same Sex Marriage: A Selective Bibliography
The Hawaii Supreme Court held that, although there was not a fundamental constitutional right of persons of the same sex to marry, the sex-based classification in the Hawaii marriage statute was subject to "strict scrutiny" and would be presumed unconstitutional unless the state could demonstrate that it furthered a compelling state interest.
The Circuit Court decision held that the sex-based classification in the Hawaii marriage statute was unconstitutional, and enjoined the state from denying a marriage license solely because the applicants were of the same sex.
Declares that the recognition or extension by the state of the specific statutory benefits of legal marriage to nonmarital relationships between persons of the same sex or different sexes is against the strong public policy of the state of Ohio.

NEW YORK - The mayor of the nation’s largest city says same-sex couples deserve the same rights in civil unions that straight couples enjoy in marriage, but he will continue to enforce New York state’s ban on gay marriage.
Mayor Michael Bloomberg’s statement, reversing his previous refusal to discuss his position on gay marriage, came the same week that dozens of same-sex couples seeking marriage licenses were turned away by the City Clerk, and that state Attorney General Eliot Spitzer held that gay and lesbian marriages are prohibited by state law.
Bloomberg said in an interview that he goes “back-and-forth” on whether same-sex marriages should be allowed, but believes these couples deserve equality.

 Same Sex Marriage
This ruling is one of the latest developments in the larger public discussion of "marriage" and "family" that started in 1993 when the Hawaii Supreme Court ruled that laws denying same-sex couples the right to marry violated state constitutional equal protection rights unless the state could show a "compelling reason" for such discrimination.
Vermont that said same-sex couples are entitled, under the state constitution's "Common Benefits Clause," to the same benefits and protections as married opposite-sex couples.
