SJC hears challenge to marriage law - The Boston Globe
In a case that could intensify the fierce debate about same-sex marriage in the United States, the Supreme Judicial Court heard arguments yesterday in a challenge to a 1913 state law that the Commonwealth has used to block out-of-state gay couples from marrying here.
In addition, she argued that state officials have misapplied the law to all out-of-state couples, even though, by her reckoning, only 14 states declare same same-sex marriages void.
But a lawyer for Attorney General Thomas F. Reilly, who says he personally supports same-sex marriage but must defend the law as the state's top lawyer, countered that Massachusetts is applying it both to gay and straight couples.

Interestingly, an increasing number of states have passed laws banning discrimination based on sexual orientation and gender identity at the same time as this battle over same-sex marriage is taking place, which only emphasises the schizophrenic nature of American politics on this issue.
Gay marriage, however, is only the newest issue to receive public attention since the forces opposing same-sex marriages are those also involved in the anti-abortion movement, the abstinence-in-education programme, the anti-evolution movement, anti-pornography and anti-homosexual-rights movement, and dozens of other similar movements.

Scotsman.com News - Latest News - Californian Law Can Ban Same-Sex Marriage
By taking the position that any change in marriage eligibility criteria must come from the Legislature, however, Lockyer essentially advanced the same legal strategy that Massachusetts Attorney General Thomas Reilly, a fellow Democrat, unsuccessfully used to prevent gay couples from being able to wed in his state.
The plaintiffs are relying heavily on the same arguments that persuaded Massachusetts’ highest court to legalise gay marriage there this year – namely, that laws limiting marriage to a union between a man and a woman discriminate against gays, violating their civil rights and several constitutional guarantees.
Both supporters and opponents of gay marriage were eager to see how Lockyer, a Democrat who has expressed interest in running for governor in 2006, planned to navigate the politically volatile question.

Louisiana's amendment was later struck down in state court on the ground that it improperly dealt with more than one subject by banning not only same-sex marriage but also any legal recognition of common-law relationships, domestic partnerships and civil unions.
