It was thought the district fight was over, and everyone would wait until the Ontario government put in place a province-wide smoking ban within the three years promised by the McGuinty government on coming to power in October 2003.
Since many areas covered by the medical officer of health in Northwestern Ontario are unorganized, the attorney general stated Sarsfield had even more knowledge which linked him closer to the health hazards affecting the people in the catchment area.

 Community Association Bill 81 Letter
We believe it is completely inappropriate for the Province of Ontario, through Bill 81, to prohibit Canada’s capital city and Canada’s 4th largest city from deciding for itself the nature of the agricultural activities that are permitted within the City’s boundaries.
We understand, based on evidence where intensive hog farming has been permitted elsewhere in North America, that a probable effect of intensive hog farms is to reduce property values in the surrounding area, thus reducing the tax base for the City and increasing the tax burden on other residents in the City.
As neighbours to Sarsfield, we are concerned that an intensive hog farm in our area could create a risk to our water supply (we share the underground water reservoir with Sarsfield).

Write to the Mayor of Ottawa at Bob.Chiarelli@city.ottawa.on.ca and to the Ontario Minister of Agriculture at Brian_Coburn@ontla.ola.org (834-8679 or fax 834-7647) demanding that hog factories be kept at least 5km away from residential areas.
It is also time for Ontario's provincial government to follow Quebec's lead in shutting down intensive factory hog farms until strict new laws are on the books and are being enforced.
If, in fact, the Government of Ontario is the final arbiter on the question of intensive hog farming, it follows logically that it be responsible for the damages that will be inevitably awarded to the affected residents.

Albert Roy, the judge in the Sarsfield decision is bound to interpret laws but in absence of any provincial environmental legislation, the judge had little choice but to grant the permit.
Ontario is the only province without nutrient management regulations in place, and under the proposed Nutrient Management Act the trend towards large-scale intensive hog operations would be able to continue.
But in Tweed Ontario a proposed industrial hog operation was successfully stopped in February of 2003 by the community thanks to a municipal by-law that was enacted solely to block the opening of the hog operation.

TORONTO – Bar and restaurant owners in Northwestern Ontario have won support in their fight against the arbitrary actions of the region’s medical officer of health.
In response, Dr. Sarsfield unilaterally, and without public consultation, decreed that all businesses must be 100% smoke free by July 31, 2002.
In Ontario, it is very clear that elected municipal politicians, not appointed bureaucrats, hold the power to create smoking regulations,” says Douglas Needham, President of the Canadian Restaurant and Foodservices Association (CRFA).
