		The plaintiffs alleged that in granting the conditional use permit, the Town Supervisors failed to follow the provisions of the Town's zoning ordinance, thus violating their due process rights under the United States Constitution, pursuant to 42 U.S.C. The defendants removed the case to the United States District Court for the Eastern District of Wisconsin.
		As the sole remaining defendant, Payne and Dolan is relying on the validity of the Town's issuance of the conditional use permit, and must therefore discharge the Town's burden of demonstrating lack of prejudice to the plaintiffs in this case.
		However, because the Town failed to substantially comply with the zoning ordinance's notice provisions, and because Payne and Dolan's conditional use application was incomplete at the time that notice of the public hearing was first given, we conclude that the Town improperly granted the conditional use permit.
