It won its composer the American Academy of Arts and Letters' Prize in 1954, and it was recorded in 1956 by the Eastman Rochester Orchestra under Howard Hanson (Mer MG-50103/SRI-75 116).
His Concerto for piano and wind octet (1928) was recorded by Grant Johannesen (1956, Col ML-5105/CRI SD-315), and also by members of the CBC Vancouver Chamber Orchestra and Linda Lee Thomas, together with his Nocturne (1958).
The Nocturne also was recorded by the Hessian Radio SO under David Van Vactor (ca 1967, CRI USD-219), and the Symphony No. 2 was recorded by the Louisville Orchestra, with Robert Whitney conducting (1958, Louisville 592).

While the statute does not compel that the recipient custodian solve a mystery to understand the request, the state's policy of openness of public records and the expressed legislative intent that the statute be liberally applied requires a reasonable attempt by the custodian to understand the request by considering the entire communication.
This is logical considering that the custodian of records has legal custody of the records and is best able to respond to the requester as to the existence and location of records for which access is sought.

In every recording contract the artist and the record company agree that royalties will be paid only on recordings that are actually sold or distributed to the general public, not on records that are manufactured and shipped but eventually returned.
If the record company had based its royalty computations on the original sales figures from its distributors, it would have already remitted royalties to the recording artist on a full 300,000 albums sold, resulting in an overpayment on 150,000 albums—a costly mistake for artists making $1 to $2 per album.
The reserve fund can pose real problems for many recording artists, since it substantially reduces the artist's initial royalty payments and postpones the date when he or she will finally be paid all royalties due.
