In 2001, Mowlem had entered into a contract with Scrabster under the 5th Edition of the ICE standard form of contract to construct a new breakwater, quay and associated works as part of a new ferry terminal at Scrabster in the north of Scotland.
Scrabster argued that it was incorrect to hold that the arbitration code governed only the conduct of the arbitration.
Scrabster argued that any requirement as to the form or content of the arbitration notice set out in the contract should be strictly observed.

Senior counsel for Scrabster had considerable difficulty in suggesting what prejudice would be suffered by his clients because of the absence of express reference to most of the matters in question.

In 2002 Orkney's main ferry link to the mainland, the service from Stromness to Scrabster near Thurso, was taken over by NorthLink, a company jointly owned by Caledonian MacBrayne and the Royal Bank of Scotland.
After a new pier able to accommodate her had been built at Scrabster and work completed at Stromness, the ship introduced onto the service was the MV Hamnavoe.
At 110m long this is by some margin the largest vessel ever used on the service and the quality (and quantity) of the accommodation on board reflects NorthLink's intention to provide a "cruise ship" feel.

A 19th-century fishing port on the north coast of Caithness, Scrabster lies beneath a cliff on the west side of Thurso Bay, 2 miles (3 km) northwest of the town of Thurso.

While this was a challenging project due to the tight timescale required by the Scottish Executive in line with the start of the new ferry contract, we are pushing as hard as we can for the contractor to complete their contract as soon as possible and to have a berth available for NorthLink.
The resident engineer at Scrabster on behalf of consultants Babtie, Mr Eric Macaulay, further explained the current situation: “We are investigating with the clients (Scrabster Harbour Trust); the contractors and the Scottish Executive, various contingencies to speed up progress on building the new quay.

NorthLink chief executive Bill Davidson today (February 12) met with representatives from the Scrabster Harbour Trust, the Scottish Executive and the Harbour Trust’s consulting engineers for the latest in a series of meetings designed to monitor progress on work at the new pier.
The facility at Scrabster is being constructed to accommodate NorthLink’s £29m vessel MV Hamnavoe on the Pentland Firth lifeline service.
While the Trust and their contracting engineers explore means by which solutions to this latest problem can be provided, and in advance of the new pier being completed, we are working with the Scottish Executive in order to maintain the best possible service on the route.

The delay in completing the new terminal at Scrabster could be costing the contractor concerned £50,000 a week in penalties, it has been claimed this week.
In an article about the new harbour project at Scrabster, the magazine suggested that it would be standard practice in civil engineering contracts for damages of £50,000 a week to be charged for projects which ran over the original duration of a contract.
NorthLink have, in turn, said that they would be looking for some degree of compensation from Scrabster Harbour Trust for not being able to use their new ferry Hamnavoe on the Pentland Firth service, until the new terminal is ready.
