Although a member of the North Carolina legislature, Spaight remained active in the militia, eventually rising to the rank of lieutenant colonel in command of an artillery regiment.
Accordingly, North Carolina supplied units for the Continental Army in defense of Philadelphia in 1777 and New York in 1778 and 1779 before the war shifted south.
This nationalism was further strengthened in 1783 when North Carolina elected Spaight to serve in the Continental Congress and when it chose him in 1787 as one of its representatives at the Constitutional Convention.
