Sepulveda argues that the People should not be given the opportunity to choose whether to accept a conviction for second-degree murder or, alternatively, to prosecute him again for first-degree murder.
Sepulveda’s argument fails to acknowledge that the district attorney has already met his burden of establishing beyond a reasonable doubt all of the elements of second-degree murder.

Sepulveda was a successful rancher and at one time had 3,000 horses, 14,000 head of cattle and 8,000 sheep, said McNew.
Sepulveda was considered one of the finest horsemen in California, an impressive accolade in a time and place where riding horses was a way of life.
Sepulveda retired in 1864 to one of his homes, El Refugio in what is now Santa Ana, and was said to spend most of his time tending his horses.

Wasden did not address the question widely raised in the community about why Sepulveda could not have been arrested when he left the house to go to work instead of relying on the riskier and more confrontational forced entry raid by the paramilitary-style SWAT team.
