Several analysts said they were surprised by the size of the charge that Serono SA of Geneva took in the first quarter and disclosed in an earnings report issued late Thursday after markets had closed.
Serono said it expects the charge would cover the cost of settling an investigation into the marketing of its drug Serostim, a growth hormone to treat AIDS wasting.
In its earnings release, Serono said that talks with prosecutors in the office of Michael J. Sullivan, US attorney for Massachusetts, have advanced to the point where the settlement charge was appropriate.

Federal prosecutors yesterday alleged that a former sales director for Serono Inc. offered doctors bribes in return for prescribing its AIDS treatment as part of a marketing program at the Swiss drug company, whose main US offices are in Rockland.
Serono disclosed in 2002 that it received a subpoena concerning Serostim, but would not describe the inquiry.
According to Slavitt, Stupak has also filed a civil lawsuit against Serono, still under seal in US District Court, alleging the company did not live up to its obligations to pay his legal expenses for the federal investigation under the terms of a severance agreement when Stupak left the company in late 2000.

According to Pfizer and Serono, the study found that 75% of patients who received Rebif didn't have a relapse after 24 weeks of treatment, compared with 63% of patients treated with Avonex.
In March 2002, just after Rebif was approved in the U.S., Biogen asked the FDA to stop Serono from saying that its drug was better than Avonex.
Serono signed up Pfizer last summer to help market Rebif in the U.S. In early trading, shares of Biogen were down 56 cents to $38.30.
